p38 2.5 diesel oil filter failure ruins engine.

oil filter i purchased from a motor factor failed,engine now is noisy,replaced filter,and all is not well,where do i stand on this part failure,is it tough luck or does the supplier get the bill?
engine is noisy not as refined as it was,and has an unsteady idle.
info required.
taking it down to garage to check oil pressure.

How can it be proved the filter did damage??

It would be a case of hear'say, without evidentual proof...i.e. fragments of filter found in engine causing dmage etc....

If you fitted it yourself, again another sticky one - they could argue - are you trained to fit oil filters, was it carried out in accordance with manufacuturers specifications and reccomendations, what tests and precautions were carried out...etc etc....

If a garage had fitted it, you would have some form of recourse to the garage or manufacturer as they have a duty of care to fit the product correctly and a duty of care to supply a product, that when fitted correctly to their spec and guidelines will not fail....

If you fitted it, and without evidentual proof it was the oil filter....your stuck me thinks....I am not a lawyer/barrister or solicitor....if you think you have a good case, consult the Citizens Advice Bureau in your area, and have a chat....its free.

If you still have the failed filter....you could consult the manufacturer and explain the issue...they might carryout an investigation on the filter and make a judgement on whether failure would result in your symptoms.....

If you don't have it....again sticky wicket as there is no item to investigate against...

still have filter and the rubber seal on top of the paper cartridge that sits on the top ends the top one had dropped to the bottom, probably get nowhere as i fitted it myself.

I would still call the CAB and have a chat with someone there...you never know your luck....or they may give you a few numbers to call or who else you could chat too i.e. consumer advice, Office of Fair Trading etc...yer never know till yer try...

however could take forever to get any kind of action.

Consumer Direct first, they will possibly say write a letter and send recorded delivery and go from there.
 
I suppose it was the right filter for the year? There are 2 different types.
yep there are 2 types one for a plastic filter housing,and one for alloy mine is the alloy make of filter is wl 7043? i have receipt for filter and filter but no box,could buy another just for the box if need be.
 
what make filter and how many miles on engine?

engine has done 126,000 miles that could be against,but on start up after changing oil and filter,top end was rattly and sounded louder than usual mainly from cold,put in some valve treatment oil which quietened the top end down,but it just did not seem right,so i checked the oil filter and found that to be at fault.
so i may just be lucky and have just had low oil pressure?
or more serious will suffer bottom end failure?
only drove it 12 miles.
 
story so far,have been in touch with supplier,they have started to build a wall up,obviously they are not just going to rollover,the mileage is high? saying the filter with that fault would not damage the engine,it would give it a lower oil pressure still allowing oil circulation, they have offered a refund for the filter which i have declined,also offered a replacement which i too declined.
don't know what harm it has done will have to wait and see only drove 12 miles but at what oil pressure?
