Im due In court Fri can anyone help !!!

In february last year I was caught by a mobile camera van allegedley speeding (41mph in a 30 zone). I replied to the force in question stateing that I was in fact doing 26mph at the time was driveing up a hill only 200yds up the road after pulling away from stationary from a roundabout. The vehicle I was driving was a n/a lorry. It was phisically impossible for me to have reached this speed.

2 Years earlier a different police force had zapped me with a hand held device while I was doing 9mph up a hill. They tugged me at the top of the hill killing themselves laughing cos the gun had come up with 38mph. It turned out the angle of the back of my truck caused the slip effect.

I informed the Constabulary involved with the latest incident what had happened the previous time and the findings of the other police force. They dismissed it as being 'impossible'. I asked to view the video evidence and they told me that I would have to go to court to see it.

Normally if you are thought to broken the speed limit and are caught on camera you would expect to be in court within a month. Oh no. The force in question held it up until JUNE with no threats of court until then. The reason is simple. They had looked up when both my car insurances were due and knowing that if an offence is ongoing it doubles your insurance until it is settled they simply waited it out.

My other half works at a solicitors and I got her to ask around for me. They said that although I was innocent and they were happy it could be proven so in court the cheapest thing for me to do was to take the points. I now have 3 points on my licence for an offence I can prove I didn't commit. It did save me £600 which is what it would have cost extra for the 2 insurance premiums.

Sometimes you just have to bite the bullet and take the rap EVEN IF YOU DIDN'T do it.

generally this is what a lot of people are saying

So we are now becoming a society of admitting offence that we have not commited.

In some ways this is why most of us are doing generally accepting all punishment that are given to us because a certain officer didnt get laid the night before or wants more browny points to boost his carreer. Surely this why we have a court of law to be able to be heard !!

I have done this in the past and accrued 9 points previous

You go to court and if you win then you hit them for a bill of costs incurred.

If I had taken it to court and lost. The average costs of that sort of case would be £12,000.
I didn't have the extra £600 for the insurance and definately not £12,000 if I had lost
. Even though the solicitor was confident we would have won he advised against it because the courts ARE bias and DO take a dim view on people contesting and WASTING THEIR TIME.
 
It comes down to what you can afford, they are getting paid to be there, you're not.
If in doubt about winning the case always easier to shut the f up and take the hit, else you will get stung especially wiv 'local bobbies'

Long stroy cut short - me big bad Company car driver new to the town, her local school teacher, she pulls out of blind side road right in front of me. Local Bobby (a long staning friend of hers) gave evidence that in his opinion i was driving reckless. (no he was not a traffic cop or trained acc investigator)

I got clobbered for 6 points and £600 + costs, but to make it worse, i was even advised by the Firms solcicitor to refuse the offer of a 3 point £30 and drving course as he felt we had a watertight case. he got paid, copper got paid, her insureance got paid, i got stung.

Watertight or pay the 'tax' and walk away.

its the law of averages how many times have you done over a speed limit etc n got away with it
i know i have freqently done 85 on the m,way got away with it :D
but got pionts fer parkin on pelican crossing when i didnt although bumper was over hanging:mad:

one more thing to think about if the crown win they can seek costd incured in prosecuting you these days:mad:

Its only magistrates at the momment or does that make any difference
 
If you dont stand up for your rights we will end up with a police state run by pepole who think that they can get away with anything.
I have a frend who owns a trucking company who took a parking ticket to the high court and won (He evan more stubbon than me.)
But i do agree some time you have to pick your battles.

what rights? the right to break the law at 2am becuase you think you can see a way out of it?

I try and be as abiding as I can

When you cant get to your own home for the last two days, and been kipping rough well someones settee.

sometimes you got to try your best to get home.

If it may seem I was out wading I wasnt and wouldnt suggest wading in the dark and on one vehicle.

You don't have to convince us, old chap. Convince the beak, break the system, then come back and gloat.

(Or get stuffed for £500 & six points, which I suspect if more likely.)

Hi guys

The CPS have just called me an hour ago

They are going to drop the case and there will be no points and charges

Would like to thank all the people that have help on this matter
