Hi all,

Thank you for your time in advance.

Well the incident happen last nite at 2am in the morning!(22 07 07 )

I live in the Worcestershire area and as you know we have had some very severe flooding!

As a keen off roader I have been interested on how much the water was rising around the area!

The Previous day I had been going around and pulling random people out of the floods just to help out!

On our way home last night I decided to go to the worcester bridge to check how bad or if the water is going down!

To cut a long story .The police officer were situated at the bottom of the road, so to get out the way I turned left closer to the river, I was immediately followed and with the blue lights.

The policeman who booked me came to my window, and on that instant I was already guilty no telling off just straight to the booking slips.

I was then issued with a £60 fine and 3 points to my amazement !!

Offence code 666 Contravening direction of cones!!

To stop my rambling I had taken photos of another route which was not coned off which would have brought me to the same spot and not through the conned area.

My arguements are,

Was my offence that serious that it warrant my three points and £60 fine.

He didnt witness the alleged offence

It was assumed that I have done what he told me!

Do i just take the rap and shut up or find other avenues to deal with it!

I went to court last month on the 22 02 08

It got adjourned to this fri 22 of march 08 This coming friday

This was the policemans witness statements which i had to retreived from the cps today

" On the Day and the date overleaf I clearly saw the defendant driving through a road closure on deansway, Worcester
The Road was completely blocked by big foot cones and road closure sign.

The police officer was parked at All saints road, between bridge street at the junction

The alleged offence at the round about on the a44 near the college yard (the entrace to a44 from the roundabout was where the road closure sign was in place.


The defendant drove the wrong way around a keep left bollard and pedestrian crossing to get around the closure when stopped and question he sted that he wanted to see the floods.

He was driving a 4x4 vehicle and appeared to be driving round the flooded areas, deliberately ignoring warning signs, just to drive through the floods.

Again he had assumed knowing my home address at this point and he would have had to do a vehicle check.

I explained the offence and issued this fpn.

He just assumed as I have a a 4x4 that I was

Basically he didint see me do anything but has issued he had it was a closed road where it took place but another access to it was still closed. So there fore it was not a completely sealed road

If you're innocent, why have you waited 8 months, then asked for help with a couple of days to go?

Aye, thas what I wanna know. If I wuz gittin stung fer sixty nicker and 3 points & the bizzy wuz being a lying ****, ahd fight it all the way. If I'd got caught out doin' what I ought'nt then ahd fess up & syait wuz a fair cop guv'.

FFS you've left it a bit late chap.
I am not a lawyer, but my job requires me to understand some points of road transport law and this would be how I would view it if it involved one of our trucks:
Perhaps the temporary signage was not laid out in accordance with the proper guidelines which lead to some ambiguity and confusion as to where exactly the signs were indicating you to go??
If a road is closed, it is closed to through traffic, but not if you require access to a point beyond that closure, unless of course that point is obstructed by the reason for the closure.
(Remember that proceeding to drive along a closed road may also invalidate your insurance for the length of that closure).
In other words if part of your intended route is beyond the closure and is easily and safely accessible without posing a danger to yourself or other people you should be able to quite legally proceed as intended.
As this happened some time ago, you would have to prove beyond all reasonable doubt what your intentions were at the time and if the signage was ambiguous in its meaning, that Police officer should have been there to help and guide you as to where to go, not throw the book at you right away.
Personally I think you have probably left it too late and may not have enough enough of a valid reason to contest any proceedings against you.
 
Thought in England that temporary traffic cones, including traffic lights for roadworks were advisory and not compulsory until official notice had been posted and time period for objections had expired?
