I'll look at the policy again...its one of these we took out when the car was bought 6 months ago..tbh they have sorted a couple of minor niggles but the Aygo is renowned for using clutches, often after only 30k (wow sible, nothing ever goes wrong with them huh? Arsetalker). She's only done 1000miles so she's naturally ****ed off..still, at least its not a landy, she'd have passed away with the amount of work!!

Could you pursue satisfactory quality and fit for purpose-Sale of goods act depending how long she has had it.

You could do worse than a call to consumer direct in the crock of **** thread for free advice

Just a thought, Storm....
I thought it was now illegal to put this sort of clause in warranties. My understanding is that any company that is VAT registered ( ie no back street cowboys) must be allowed to carry out warranty work.
It might be worth taking legal advice. - pm Spudy????

think you're right on that, daft

hang on - she bought it 6 months a go and has done 1000 Miles - then its the dealers responsibility - your complaint is with them, first. The warranty is an added extra - not a replacement - they cannot shirk their legal responsibility - have a look at this - and similar. Sounds like a good case for trading standards .

I draw your attention to the following....

"If you have a problem with a secondhand vehicle you have bought from a dealer, first work out what rights you have and decide what you want the seller to do about it. It is the dealer and not the manufacturer who is responsible for dealing with your complaint."
"If the vehicle came with a guarantee or warranty, you might find it easier to claim on this if the dealer is refusing to give you what you want. Guarantees and warranties can also be very useful if the dealer has gone out of business.
It can also be more convenient for you to make a claim on a guarantee or warranty "
"You may have bought an extended warranty with the vehicle. This is an insurance policy and is a separate contract between you and an insurance company. However, an extended warranty cannot take away your rights to make a claim against the dealer."

If the car was sold with a guarantee or an extended warranty, you may have
additional rights. The guarantee or warranty cannot take away your statutory
rights. You should check the small print on your warranty. Many have exclusions
such as wear and tear.
If the car is faulty and you have left it too late to claim a refund or you don't
want one, you can ask the dealer to replace or repair it free of charge. If you
do this within six months of receiving the car, and it is reasonable to expect it
to have lasted for the period of time you have had it, it will be assumed that
the problem existed when you bought the car, unless the dealer can show
otherwise. However, you can still ask for a replacement or a repair for up to
six years from the date that you bought the car, if it is reasonable for it to have
lasted that long. In this case, it will be up to you to show that the car was
faulty at the time of sale. The longer you have had the car, the more difficult it
is to prove that the fault was there at the time of sale.

If it were me I would complain and say that there should have been an immediate recall (for checking) as soon as service bulletin CP-8016 was issued in October 2008.

If your Aygo has been into a toyota garage for servicing since 10/2008, you have nothing to argue over. This service bulletin is "necessary to ensure maximum clutch disc lifetime for cable type clutch systems"

OK - I worked this out. Technical Service Bulletins are available from Toyota Tech at Toyota Service Information - for a cost (3€ buys you 1 hour to download as much as you like).

Regarding the clutch, TSB CP-8016 is actually a clutch adjustment bulletin to ensure there is good free-play in the clutch pedal. Apparently, a lack of free play leads to excessive wear of the clutch disc. This was published in October 2008 and was supposed to be implemented as a pre-delivery check for new cars and at each regular service interval.

A further TSB CP-8007 (published June 2008) acknowledges customer's concerned about premature clutch wear. The repair procedure described is to replace the clutch disc and cover assemblies with those used on Yaris KSP90. Notably, the clutch engagement point will be about 2cm lower than the standard Aygo clutch.

Also, in December 2008, TSB CP-0067 was published summarising symptoms including: slipping clutch; abnormal smell; premature wear of clutch disc; and squeal noises from the clutch during stop and go. In terms of early wear, CP-0067 describes the clutch pedal free-play issue and further considers the materials used in the clutch cover and disc. To address early wear, CP-0067 mainly recommends checking the pedal free-play. There is also a production change in this bulletin to a 7.5inch clutch discs and covers (from 7inch) - likely to address a resonance issue causing squeal noise in the clutch.

In view of this material, it seems to me there is a design fault (and consequential manufacturing fault) in the Aygo clutch for vehicles produced at least before June 2008 and possibly later. Early wear of the clutch disc is therefore to be expected for these vehicles and they should have been recalled. Costs incurred replacing clutch discs suffering premature wear should be borne, at least in part, by Toyota in view of the fault.

In that case yu are on a winner. Car has to be fit for purpose and it is the garages responsibility to prove the fault wasn't there when yu purchased it. Small claims if necessary with fannys data :).
