Freelander 1 MOT and EGR Removal

I expect most on here will be aware but for clarity to the Newcomers including myself I enquired today with a friend who is a mot tester whether or not it was illegal to fit a EGR mod kit and the answer was YES IT IS and something the government wants tightening up on however the everyone's doing it response from me was confirmed with a Yes but they are not presented for MOT with the mod kit on ( WINK WINK )

gut the original EGR and no ne will know the difference
