Even the Fiancee said that asked if there were anything had been captured on video as we both know that there was not a inklin of chance that they would have followed me or myself in their range to seen me

but be prepaired for the above in court don't stammer make sure you stick to the fact's and give your statment clearly so has not to need to be requesioned...and last but not least do not lose your temper at any point in the proceeding's..

why not join 4x4 rescue resource n get called out in floods next time by police threr on here do a search fer them

We are actually between two rescue groups

Gloucester and redditch

we have spoken about it and have spoken to relevant people Police, fire ...

What happens if the court officials or cops who stopped you have been reading this thread, you might want to think up another excuse and keep it to yourself just in case, now that the whole world has read this and knows your guilty.

Like I said I drove down the road and got to them they were parked stopped stationary not moving with their blue lights on

I turned left to avoid the lights as he wa partially blocking the road

The signage was half up the road

Again he did not see me in any way until I came in line to his mirror when he was stopped.

The road was not sealed off there was another access to it so the supposed road closure was not sealed in all direction

next question would have to be, are you sure the cops you seen staionary and with lights on was the same ones what stopped you.

unless yer not being clear again there is nothing to indicate if the cop that seen you was the same cop wot stopped you, and are you sure the cop what stopped you was the same cop what YOU seen?

look at it from the cops point of view, the road was closed as someone decided it was too dodgey to drive down it. most folk have cars and not 4x4's even if they did have 4x4 its no indicator of their ability to drive it properly through deep water.

B/ the emergency services didn't have to deploy to pull them out
C/ no one was drowned because they had become engulfed in deep water ( remember that flash flood that near wiped out that small village)
D/ the emergncy services weren't put unnessecerily at risk

and it was 2am he had probably bin pull off the top of his missus to go and sit in a cop car in the pouring rain in the early hours of the morning.

and you getting nicked might stop the next bloke in his bmw 318 from drowning as he tries to drive through flood water in his unsuitable vehicle.

As I say my itention was to try and get home having been away from work for the week and staying out on friday nite from home again I didnt fancy.
I wouldnt put my myself in danger by wadding at night and not knowing the surroundings and no one with me but one truck.

The road was closed due to the bridge being class as unsafe so no it wasnt engulf in water so no wadding involve unless you want drown in the river which I woudlnt recommend

there was a lot of cars under water even fully submerge at the time on certain areas
 
This is the officers witness statement.

""On the Day and the date overleaf I clearly saw the defendant driving through a road closure on deansway, Worcester
The Road was completely blocked by big foot cones and road closure sign."


"The defendant drove the wrong way around a keep left bollard and pedestrian crossing to get around the closure when stopped and question he said that he wanted to see the floods. "

He was driving a 4x4 vehicle and appeared to be driving round the flooded areas, deliberately ignoring warning signs, just to drive through the floods

Although I will not question your reasons or responses...you have suggested that the Plod couldn't see you...not that you hadn't driven through the cones.
If the cones were in place, certainly on the RHS of the road to stop vehicles ENTERING the area then you must have driven past them and done so on the LHS of the road.
I dunno about the bollard and pedestrian crossing but if they'd been placed in a position where you would have to drive on the LHS past the bollard and pedestrian crossing, you must have done so.

The plod may have been tired, narky, cold, slapped by wife...I dunno. BUT, even if you can prove he didn't see you, you did still drive past the cones, bollard and pedestrian crossing to get to where he was...so you did contravene the traffic laws.

The mitigating circumstances are that you were trying to find a route home and wanted to speak to him. You wanna try throwing yourself on the mercy of the court for 3 points and £60?

I'd take the hit. I'd be furious, especially if plod is being devious about seeing you, but the fact you were there proves you did as he said.

In that event, you should be able to indicate where the plod suggests you trangressed the traffic laws by passing the cones etc., (better yet, get them to indicate where the cones were placed), show where you entered the street AFTER the cones, advise that plod is making assumptions on how you entered the area, and dismiss allegations that you transgressed the traffic laws.

THEN it comes down to word against word and I'd still be less than convinced the beak won't side with the plod...then you will get a larger fine etc. etc.
 
I know even on his witness statement I think assumption is what hes been thought !! instead of hard evidence !!
 
Its 3 points and £60 quid for gods sake its not life imprisonment, stop moaning pay up shut up and get on with your life


Gotta agree, life sucks and it's all very unfair, but pursue it and you'll just get stung for more.

Don't let pride or anger skew your judgement. Pay up with a smile on your face, tell them you've very very sorry and put it all behind you.

Sure life sucks, but it's also far too short.

I disagree, fight it if you are innocent. This countries ruling party, The Police, rely on us just rolling over an meakly letting them tickle our tummies with these instant fines and points.
Whatever happened to innocent until proven guilty? It is total bawlocks.
 
If you are determined to fight in court - (remember a lot of these cases get thrown out because the officer doesn't turn up) your only chance is to pick a hole in his statement. You only have to prove one inconsicency in his statement to discredit his entire charge. You don't need to hire a lawyer etc - it is quite easy to represent yourself provided you believe you broke no laws. It is far easier to defend yourself if you honestly believe yourself to be innocent. What you need is evidence, evidence, evidence. Just a little bit of preparation will go a long way. You stated that on the map it was not possible for the officer to see if you passed the barriers - then you need to print of a large map and detail all the locations on it to descirbe what took place. You need to return to the area and take photos to back up what you have said. If you can prove that the officer could not see you as he stated then his whole statement will be dismissed. Be careful though that this evidence cannot be used against you. I have been to court many times and in all cases never is the phrase "a picture tells a thousand words" been more important.

Good luck in your case - be very polite at all times and try not to get personal. Write out your case before hand with ready to refer to notes. Apologise to the judge for your crude presentation but you are a layman. In many cases the judge will give you the benefit of the doubt because you are a layperson. The prosecution may try to ask the same question in many different ways - don't get muddled -

I have done most of what you have just suggested

Firstly I took photos of the route available to get into the area as it was not sealed as the Officer may have thought.

I have drawn on a map where I encountered the officer in his car and where I was stop and where the signage was in place

Yesterday I took more photos of the area to be able to show the judges that, there is no way where he was parked to have witness me to have come from possible three direction

Lastly all of his witness statement had been based on assumptions

yep Im just starting to compile to pick at his statements
