Fighting HMRC at present regarding my 110 Defender SX Station Wagon.

I bought it new in October 2005 with General Grabber Tyres, Boost Alloys, Uprated Suspension and a Bulletin from Land Rover stating that as it has a payload of greater than 1000kg then it is classed as a commercial for tax purposes.

Tax office stated this is, along with other strong evidence is 'inconclusive'.

What I could do with is another Landy owner who has had an experience from HMRC where they have a similar vehicle which HMRC class as a cammercial or Van for Tax, and not a car.

Can anybody offer assistance.

(Usual comment such as 'does it have seats? etc etc do not hold water as facts show that this vehicle, along with the county station wagon 110 IS a commercial.)
 
I think what he is getting at is...
If it is classed as a car then he will pay a SHED load of TAX on his wages if he is using it as a company car due to emmissions....
BUT if it is a commersial vehicle then it is only £500 a year TAX agains his wages..

I had this problem when I had a company FORD RANGER Double Cab, once I put a Truckman cab on the back it changed from a Commersial to a Car and my TAX went up, so off came the CAB, cheaper TAX again.
 
Thanks very much folks, you are on the right lines.

Land Rover themselves state that it is a commercial and thus is a 'VAN' for tax reasons, which is what we have been putting through on our accounts, until this Local Compliance Officer comes along and states otherwise.

We have facts as long as Mr Tickles arm, but she is so far removed from what a Defender actually is she is not accepting them

In May 2007, after 13 months of stating the facts, she and her superior (who came to see me due to a small poem/story I wrote to demonstrate her foolishness) both stated that they had never set eyes upon a Defender at all other than in photographs!

So, what I would like is support in the form of someone else who has had a similar experience with the HMRC tax office in the UK and could offer a 'case' which we could quote to them which would reinforce the concrete examples I already have but can't make them see.

Failing that, watch this space and this shall be a test case for the mighty Defender in the UK, as is now booked to go to the commissioners. 2 Years from their first raising it.

Methinks they are somewhat unsure.

A mate of mine drives a disco 3 (non commecial) for attending breakdowns for landrover assistance. He also uses it as a company car. Because it is sign written it is classed as commercial. Why not contact landrover assistance and ask what they pay and also ask for a couple of piccies. (As a 'business' customer who is thinking about buying a Brand new vehicle. :D wink wink :D ). They should be only to pleased to help.

P'raps your mate could let me know if he gets 'van' tax on his disco, although I doubt it.

Mine is much more cut and dried and yet they (HMRC) still can't see it.

Commissioners appeal letter came in today so we'll take them to the commissioners and see the outcome.

Your right with the double cab bit, add a canopy then is a 'car'. Take off canopy then is a 'van'. This is due to the payload weight being just over 1000kg without canopy and the canopy being included in payload, thus when on remaining payload is under 1000kg.

Fing is tho' ontop of the manufacturer giving correspondence confirming that it is a 'commercial' and therefore a 'van' AND the VAT dept alllowing 100% VAT back as with a 'van' that the actual payload of me land, with roof (or canopy if you like) is 1045kg.

I am pulling my hair out to make HMRC see that they are flogging a dead horse.

So, many thanks for comments, keep them coming and ask around for any other assistance which you may be able to offer.

Thanks for your interest, never having done anything like this before its much aapreciated when folk respond, in any way.

No fiddle mind, Defender chosen to d job like a farmer, utility co etc etc and boy, does it do the job.
