Series 2 Disco Tailgate Problem

Great forum this, I shall be having a good look around on it.

I have a 52 reg series 2 discovery and have a problem with the tailgate. I can't get it to open, not from the outside or the inside. The handle is stuck in the up position. has anyone else experienced this?

Also, the rear tailgate seems to leak water a little at the top, it looks like it sits away from the seal at the top and much closer at the bottom.

Common as anything, this.

Small screwdriver, pop off the LR badge on the tailgate lock surround, push handle back down. While you're there, give it and its pivots/springs etc a GOOD spray with spray grease or similar and work the handle up and down. WD40 works for a bit but it will seize up again - greased mine 6 months ago and still working well.
