New MOT regs?

Hi everyone,
Now i know this has probably been covered a million times.
But can i get away with the egr removed and a decat pipe on the 110 td5?
Ive spoke to storm tuning as im heading there for a remap, however prior to this pipe n egr must be done.
Enquires were made and ive been informed that it will still pass.....as technically a mot tester can not remove anything to do the "visual" checks that are now needed.

Also Because the older 10p engine didn't have a cat and the MOT system doesn't identify which TD5s are fitted with cats they can't fail it aslong as you don't go with it obviously chopped out and a straight bit welded in.

Is this correct? As i would hate to go through with it all then have a fail in which im not allowed to drove the vehicle away.....as the threat states in new mot rules

My Td5 has just gone through with decat and EGR blank.

Is that right if it fails you can't drive it away??

Don't worry about no CAT, the EGR will be down to the examiner on the day.

Official MOT handbook, section 8: Exhaust Emissions

Read section 8.2.2.1

Removal or tampering with the manufacturers emissions control equipment is a major fail.

Having said that, it seems that MOT testers are passing vehicles with EGR deletes and mods, presumably because they are hidden under engine covers. I'm hoping this is the case because I've removed mine and my MOT is due soon.

I refitted my CAT and EGR and have not noticed any loss of power, or any increase if fuel consumption but have noticed a much improved cleaner exhaust smell and a different exhaust sound after refitting the CAT (had a slight whistley sound before). I did fit a new genuine middle box at the same time which was a bit smaller than the one removed but length between flanges was the same, this was taken off a new defender/Puma or whatever they are called. (Ebay £85 for a genuine landrover box, a bargain)
So if you still have your parts I would refit them before the MOT.

One question, how would the garage enforce you not driving away?

They don’t have powers to detain you or seize property i didnt think? Granted they could call the fuzz as soon as you leave but surely they can’t acually stop you leaving?

It's a bit of a joke making emissions a "major fail", this should be reserved for safety critical faults, you would have thought

The governments new line is that emissions are a safety critical issue. Critical to the safety of the general public, who suffer the respiratory and other diseases caused in part by vehicle emissions.

Going to replace my EGR for the next MOT and cut a thin blanking plate to fit over the exhaust connection and/or disconnect the vacuum pipes from the valve body,

Cut and blank the vac pipe somewhere where it cant be seen, if you disconnect at the EGR or vac valve that can still be seen to be disconnected and would be classed as tampering by an anal tester!

The stuff of nightmares.

The way I read it you can drive it away unless its a dangerous fail and some major fails will come into that category.

I think garages will be a bit cautious, if they prevent the vehicle from leaving their premises they will lose that customer. I've been using the same garage for years for family cars and my motorbikes, if they upset me, they stand to lose at least a couple of grand a year.

how would they physically stop you though? Surely they cant actually physically stop you, if you wanted to drive it away?

some garages could use it to 'force' you to use their services
- vehicle fails
-garage says you 'cant drive it away' so it HAS to be fixed at that garage.
- garage adds 50% onto the bill....

Defects are now categorised as "major" (fail) and "dangerous" (shouldn't be driven away).

Emissions device tampering are a major defect but not a dangerous defect so nothing much has changed....you can drive it home but are still subject to normal rules regarding roadworthiness so in theory you could be prosecuted just like under the old mot guidelines or at any other time irrespective of whether you have an mot or not.

So far as I'm aware mot testers are being told that it's their responsibility to advise people with dangerous defects that the vehicle should not be driven on the road at all until fixed but it's not their responsibility to ensure its not.

It is legal to drive a vehicle without a current MOT to a pre-booked appointment and drive it home after the test even if it has failed.
