If a complete headlamp unit has been replaced with a unit that was manufactured with HID or LED light sources, it must not be failed for ‘Light source and lamp not compatible’ but it must meet all other requirements detailed in section 4 of this manual specific to the type fitted at the time of test.

Vehicles with high intensity discharge (HID) or LED dipped beam headlamps may be fitted with a suspension or headlamp self-levelling system. If these systems have been fitted, they must work.

Strangely, according to the OP this vehicle didnt fail due to the modified lights but cos the levelling doesnt work o_O
That's because they are modified.
Original lights would have level adjusters so the tester is right to fail the vehicle because it has a modified lighting system that doesn't work as it should when originally built.

Fail is correct

I didnt say it isnt correct just that its strange that it failed just for the sdjustment while as you say it should have failed cos the lights are not original regardless of adjustment. Based on this failure the OP(or others too) might think that if the vehicle apears as it's not fitted with headlamp levelling it should pass regardless of the modified lights hence the subject of this thread. A whole MOT mess IMO

Yep
Putting in a modified vehicle for MOT is mostly going only one way nowadays
