Freelander 2 (LR2) Misfire problem

My Freelander 2 2.2 TD4 (99k miles, 1997 model) started misfiring badly and constantly on the way to work on Wednesday morning. I had to call the AA, and the guy spent quite a while trying to diagnose the problem (nothing obvious on the diagnostics and it didn't go into engine management mode). He said it would need more detailed investigation and towed me to my regular garage.

They've had in in the workshop ever since and haven't managed to solve the problem. They took off the intake manifold and found a "flap valve" had broken. Having googled this I think it must me a "swirl valve"? Anyway they replaced the whole intake manifold (since this valve was obviously broken) and checked the cylinder valves on that chamber (in case any bits of the broken valve had been sucked in I guess) and said that the valve seem to be seating okay. But this has not fixed the problem and they are a bit stumped to be honest.

Any suggestions? This is getting worrying.
 
Sounds like they replaced the throttle housing which is primarily used for engine shutdown

If it was the port deactivation valves which had broken up then generally these lead to big engine failures as the bits of material get ingested into the cylinders and smash their way out.

Need to get it properly diagnosed by monitoring real time values for the engine management readings such as fuel pressure, EGR function etc to find out what is out of spec

The garage will have had it for a week tomorrow - at what point do I say enough's enough, you aren't getting anywhere? Do I have to pay them for the time they've spent NOT fixing it?

If these bits of valve have been ingested and shredded the engine where do I stand? It seems to be to be a major design flaw if that sort of thing can happen under normal use in an engine with full service history. Don't suppose I'll get anywhere with Land Rover, but is this a known issue? Should there have been a recall on it to modify the offending part?
