light/brake light problem

ive noticed when have the lights on, both the rear light and brake lights work off the same bulb.. any ideas what problem could be?

think its normal (not that i;ve checked my d1)

They brighten up once brakes are applied and are dim with lights are on

The D1 rear tail bulb is combined with the stop light, the bulb has two filaments.

Haha. I look a right dafty now. Mrs was pull over for brake light aswell as smoke. That's the only thing I could see, thought it was a wiring/earth prob.
