Collecting a vehicle isn't a crime.
The crime is not taking it back...

Fraud can be criminal or civil. In this case i assume criminal as the police have charged them.

This just shows why it's so important to find a mechanic who you trust and treat them like a god!!!!!!!
I'm lucky. I have three. My cousin and his son and a mate who repairs cars and MOTs them too. OK we have an issue in that he lives to scrap Discovery 1s, but we work around that :D

I'd agree with that view if the engine wasn't up to much good, or the gearbox was left hanging on with only one bolt or they dented or scratched the bodywork. Yes, that would be down to bad service.
But when they take the money up front and then refuse to return the car, i'd call that theft.

Personally i've paid some up front. Usually because i've had the money on me at the time. Sometimes i've supplied parts. The difference is, the guys i use are straight as they come and i trust them 100%.
Hell, i've sometimes collected the car and paid them afterwards!
I would be very suspicious if ANYONE who was doing work for me demanded money up front for anything!

Borrowing without consent is the usual fun bag of lame excuses, which normally ends with a guilty plea....

The main issue here is the prosecuting authority, CPS (upon receipt of evidence from plod is so motivated to obtain it...:cool:
And Trading Standards AKA the local council, see my not in the above line about motivation, sadly the loser's complaint is not enough, however a letter to the chief constable, and the leader of the council, combined with the local MP and the local council cabinet member for public protection.....well thats we see action, if there are votes involved.....ask me how how i know this.....

Bench will send upstairs IF found guilty sentence is outside their ability to impose, (this is before the trial starts) plea before venue etc
Or they can try the offence and still send to crown for sentencing. (retain jurisdiction)

Conspiracy to commit Fraud is indictable only, AKA straight to crown..... which is what these muppets should have been charged with.... hopefully local press will be following this.

Yes, but at the moment it is being heard in magistrates court. I hope they do pass it to crown court. Magistrates are restricted to a six month jail term.

Mags max is 12months custody and fine (for 2 or more offences).....

Ah yes. Taken into consideration. I remember him telling me how good that was. How they couldn't pin anything else on him. Then telling me how they had stitched him up because he got the full six months inside because of his list of extras. Originally he was only looking a (i think) a further driving ban and a fine!
It was him who told me how he learned the difference between TWOC, taking without the owners consent, and theft. TWOC means in effect joyriding. Where you nick a car but don't intend to keep it. Theft is when you intend to deprive the owner of his car.
He shot himself in the foot with that one too.

At least he's a good boy now. Has been for a long time. It's funny how a good woman can beat the stupid out of you :D:D

Yer splitting hairs. They have taken vehicles and not given them back. The fact they have done this to so many people suggests it was their intension all along. To date we don't know of any vehicles found, regardless of them being kept, sold or stripped. There is no action against them for this activity, currently.

There's value in what's taken even if say the engine is fuked. It's to our understanding they mostly want engines and gearboxes. Its said they ship them out of the uk. The rest of the vehicle disappears we assume as they're never found. By the time the owner realises... its probably already been 'processed' to hide it for good.

The case against them relates to bad business practice, of pushing up prices. Theres no case for nicking cars, regardless of how we describe their collection and none return scam. So looks like they will get away with that.
