I can help with some authority in this field.
Under distance trading law a buyer is entitled by law to a full refund, once the goods are returned regardless of the reason why, prided a claim is made to the seller within seven days of the buyer receiving the goods.

However like e erything their are exceptions such as, if the goods are specialy ordered in or if the seller clearly states no refunds as part of the selling agreement within their terms and conditions.

With regards to them using the same name, this is allowed until the second name user registers it as a LTD company or if the name is trade marked such as coke a cola or pepsi.

Sole traders can trade as they want without any real worries. Even once the second company registers with companies house as a LTD company, the first one has to file the complaint.

I know as once owned a LTD company and three sole traders in my area started using not just my name, but also my logo and even in the same line of business.

It all became a turf war.

If you have no success, I fact even once you do get a refund, I always google his address, get names of the companies around him or neighbours and write to them all naming and shaming him with just the proven facts.

I had exactly the same experience with a company in Bristol called Pegasus.
eBay don't allow negative feedback any more and a seller can get it removed so what I do is leave neutral feedback and just right " email me at ******@****** and I will prove to yu why you should NOT buy from these"

Any one who then emails me gets a copy of all the corospondence so they can make their own mind up.

Pegasus lost at least thirty sales this way all of them around 2k each.

I know it's easy for us to say, but stay calm, don't get mean get even.

Well give them there dues, had some messages by 9 this morning.

Asked if i would like the missing/replacement parts sent. Or allow a courier to collect then issue full refund.

So i,ve opted fur full replacement ....lets hope they are true to their word if not is all documented on ebay. An it was the Landrovers Utd comapny an all.

Best get looking again fur a dog guard.

They took me for over 1k , reported it to eBay, PayPal even trading standards and never got the goods or my money back. I still have all the documents as proff the owner to be a real git. I even have an email from one of his staff confirming how he trades.

Best of luck to anyone who gets involved with them, that's why give the evidence out and let others decide, if they are to blame or was it just me.

After this I did a course in consumer law.

T'is 7 WORKING days an all.

Can't find anything is the DSR about stating "no returns" - this is just a fancy thing eBay offer which has no legal standings for "buy it now" products.

Interestingly, if the seller does not provide certain information in writing with the goods including the buyers rights to DSR, trading address, etc. the DSR is extended to 3 months!!!

For some reason you have to refund within 30 days, but, cannot demand the goods to be returned to you before you refund. This seems a bit retarded to me, however, if you state at the beginning of the sale that return postage is the buyers responsibility then that's fine, but, if you don't state it at the start then it is the sellers responsibility.

You can't charge a restocking or admin fee either.

It took me ages to study and find out what was right and what was wrong. By the time all this had happened my legal time line had expired.

Another point to remember is regardless what any common misconception may be the law is not on the side of the person forming the complaint.

In my case the person I was dealing with Claimed to be the director lied continuously. It later transpires he was struck off as I director two years before by companies house. He has also gone bust a few times and just restarts the company back up with a slightly different name and a family member as director name.

So with a history of this do you think it's worth the fight.
During all this my father was taken ill with cancer. The stress of it all and dad had an effect on me (epilepsy) I became so ill I too gave up the will to fight, shortly after my father did too and passed away a year ago last January.

Dad died on the 7th and in the 17th my wife was diagnosed with a growth on her lung. Since that day iv pretty much given up fighting on most things, life's just to short.

I don't believe in getting mean, just get even. I'm not doing anything wrong by giving others my evidence and allowing them to make their own minds up before dealing with this company.

You can't hold the company responsible for the courier. Most couriers quote collection time of at least 9 --> 5.30 - i think DHL now quote until 8pm for collections.

i ken Bump ........but they said tommorrow day time normal working hours.

Just annoyed wea these shower of cu$ts that took money and gave me what is to me scrap metal.

If the courier arrived at 6 it's not a million miles off working hours. At the end of the day no company controls the couriers, I've had it before, on a guaranteed next day delivery then they don't deliver it till the day after. Customer goes mad. What can I do? I've paid the premium for the required service, but, the couriers do what they feel like :mad: try ringing a courier up and they just shrug their shoulders and blame traffic or weather or whatever.
 
Well give them their due got a full refund today after they sorted out collection of the old guard.

So ended up buying an other one and it fits fine so happy enough.

Need to keep these pair in the back of the wagon!
