Could be the car or the FOB, if the FOB LED flashes then it could be the RF receiver. You'll know if the new one doesn't work.

The key is dead again,no flashing key fob,i will try it in the car again later when i finish work at 2.30 . Thanks lads.

Sometimes the solder joint for the battery contact fails, if you can split the FOB without too much damage, it can be re-soldered
Best wait until the new one arrives before you destroy the old one

All seems a bit random now,still with the old key sometimes it will start and sometimes it wont but i have started it 5 times now on and off when taking the key out off the ignition if you know what i mean.
Only when i enter the eka code though.
It seems to loos it,when its been ticking over i switch it off and then go to start it "nothing" take the key out, lock the door with the key not the fob and it all locks, unlock the car with the key and it all unlocks and the interior light comes on so i guess the key is synced but still nothing on the keyfob buttons,and the indicators dont always flash and then it won't start.
It will only start if i can get some lights flashing on the fob and go through the normal process, so is this looking like the keyfob fault rather than the car.

Good show,glad you up and running.Now you can try and repair your original Fob or if you dont want to do it yourself try one of the experts like Callrova or such like.
