you can use a closed road if it is to gain access to property, as you said the orificer assumed you were there to go wading, but you killed your case the second you said you were there to see the floods
 
but did yer or dint yer do as he sez yer did?, whether you think he saw yer or not


I was trying to get home I have worked away all week got back friday and that was really bad so thinking late sat early morning sunday I tried to get home so I could go to work on monday

And No I was not playing in the water at he just assumed that because I was a 4x4 driver
 
To cut a long story .The police officer were situated at the bottom of the road, so to get out the way I turned left closer to the river, I was immediately followed and with the blue lights.

He didnt witness the alleged offence

you say you seen mr plod but he didn't see you!

if you seen them then its not that difficult for them to have seen you unless yer wur in stealth mode.

course the fact you was followed immediatly would point to yer stealth mode not operating properly.

Well there's your stalling tactic. Due to the CPS's negligence and refusal to supply vital documentation. You have been unable to instruct a solicitor to represent you and you therefore need an adjournment, in order for you to be able to mount a proper defence.
 
FFS you've left it a bit late chap.
I am not a lawyer, but my job requires me to understand some points of road transport law and this would be how I would view it if it involved one of our trucks:
Perhaps the temporary signage was not laid out in accordance with the proper guidelines which lead to some ambiguity and confusion as to where exactly the signs were indicating you to go??
If a road is closed, it is closed to through traffic, but not if you require access to a point beyond that closure, unless of course that point is obstructed by the reason for the closure.
(Remember that proceeding to drive along a closed road may also invalidate your insurance for the length of that closure).
In other words if part of your intended route is beyond the closure and is easily and safely accessible without posing a danger to yourself or other people you should be able to quite legally proceed as intended.
As this happened some time ago, you would have to prove beyond all reasonable doubt what your intentions were at the time and if the signage was ambiguous in its meaning, that Police officer should have been there to help and guide you as to where to go, not throw the book at you right away.
Personally I think you have probably left it too late and may not have enough enough of a valid reason to contest any proceedings against you.

The route I had taken was open only when I got the fpn I saw the sign on the way out so basically whilst one access was closed I had accessed it another way into the area which was not sign but was just open as normal

And yes the police offier did chuck the book at me and the fact I wanted to get home and finding a way to your home aboded had become a crime.
Therew was no compassion in the sence that oh rifght you live where is flooded out and try and be helpful
