I agree 100% with you there.

sorry nobby ****e carrying driver, its your fault,
driving without due care and attention is a slappable offence on normal roads.
I bet the Insurance company right off the slitty for that damage -
ask her to sell it to me for cat c repair work :)
getting good at it now.
 
Feel for you, it was a stupid place to park, and even if the stuff wasn't in the back do you think you could see her, but you ran into her so that usually means you get done

If you were parked at the same angle but closer as you say that vehicle would surely have been visible in a correctly adjusted passenger mirror? I did the same last week but luckily only a wheelie bin got doofed.
 
You had a large blind spot because you were carrying a load, therefore you have a responsibility to check there's nothing there. It could easily have been a child, or the farm dog, or the driver walking between the vehicles. Think yourself lucky you're only facing an insurance claim, and not a serious charge or having to live with the fact you killed or injured someone.
 
I feel for you, and think others, while being technically correct, could offer some sympathy.

While none of us would dream of backing out of a space in a busy supermarket car park without having a very good look in our mirrors and over our shoulder, would we all do the same in a farm yard, when you've just jumped in the cab after approaching your landy subconsciously noting that there was nothing behind you....?!? Come on.

You're a victim of circumstances, but that doesn't change the blame unfortunately, which firmly lies with you.

Re the child/dog comment - you wouldn't see a four-year-old or dog in your rear view mirror loaded or unloaded, so unless someone watches you back every time you reverse we all take a small and calculated risk when we back up...

I have every sympathy for his actions- I have had a rogue bollard leap into my bumper in a suicide bid whilst reversing :eek:- as someone has already said- there but for the grace of god go us all BUT .... What I think people have NO sympathy for, is his attempt to avoid taking responsibility for his actions

You're absolutely right, he is of course 100% to blame and should make it as easy as possible for the lady to rectify the damage to her car.

You know what it's like when you apologise for doing something then the other person is a twt about it then you think actually there a twt so stuff them, I think this is what has happened
 
I just find it mad, that he says he has to park his Landy, loaded with over half a ton, on a flat spot, to stop it rolling away, because he has no hand brake..
Why did he not park in the car park, like he reckons the lady should have, ho because he's got no brakes, maybe she didn't have any either, why she parked next to him in his private spot outside the farm shop.

Oh the irony Dom, life to live but you feel it necessary to take pictures of your indiscretion and post them online. :pound: are you going to Man up and accept liability?
 
Could driving a car that you know is faulty (handbrake) be a reason for the insurance to not pay up?

Also, if your engine was running and you were sending a text then you are not in complete control of the car - especially without a handbrake engaged!

Probably just worth admitting responsibility and going through the insurance....then fixing your handbrake :)
