hi, could any body tell me if i have 18"wheels on my td5 and a 16"spare on the back is this illegal. thanks

Don't think it is illegal to have a 16" spare when you have 18" wheels but it would be illegal to fit it and drive on the public highway, also fairly dangerous
 
The size of the wheel doesn't matter its the outside diameter of the tyre that counts, check out the space saver spares fitted to a lot of new cars but they come with all sorts of caveats. Although its probably legal it's not good practice and if you crashed with odd sizes your insurance may well walk away.
 
I have 15" wheels with 225/70/15's on all 4 but have 195/60/15 spare. If I have to use it in an emergency, would this be illegal?

Something tells me it would be but on the other hand, space saver wheels don't usually have the same rolling radius, yet they're not illegal for temporary or emergency use.

Any ideas?

I think you will find space savers do have same rolling radius however the are not the same width and the wheels are smaller diameter.
