Hi all

Just wanted to have a rant, some stupid bitch tried to park in the spot next to me in a car park, then realised that the spot was way too small for her massive estate car (wasn't even big enough for a mowped!) she started to reverse her car then side swiped my rear bumper and scuffed and scratched the entire corner of the bumper and knocked out the rear parking sensor!!!!!!!:mad::mad: Then the stupid bitch had the nerve to try and drive off:eek:, but luckily i was sat in my car just about the get out, so i jumped out and legged it after her and got all her details!! what a cheek! hit and run!!!!:mad: stupid bitch was as dense as pig ****! now i have to go through the insurance companies to try and get it all re-painted and put back to how it was!!

Rant over:mad:

ive had this before some insurance companys will try and get out of it by saying as its in a carpark its not coveredand its a civil dipute works well if you at fault but as not your fault could be hassel for you

now, now dont scare me, i did nothing wrong so im not going to loose out, my car was perfect before she hit me so her insurance company should repair the damage back to the mint condition as it was before she hit me Isn't this why we pay for insurance, to cover these type of accidents to other peoples cars.

erm while they are open to the public its the same as being on the public highway!

Erm thats not true! Although it is open to the public its still private property (Private as in the supermarket owns it)

You may find that even though it wasnt your fault your premium may still go up!

This happened to me and i wish i had just took it out on his face and then paid for the damage me sen!

i have been hit in a car park (tesco)the other insurance paid out no problem, just took their bloody time (7 months),but my car was a right off.
didn't take the first offer!

As suggested earlier, if you go through the insurance you will end up paying for it through increased premiums for the next 5 years regardless of whose fault it was.

You'd be better off trying to get her to pay for it herself.

The thought of that was the thing that added strength to my braking foot to avoid the stupid bimbo that cut me up this morning. It's sooooo tempting sometimes!

a carpark toi which a member of the public would normally have access (I:E supermarket pub etc) is classed as a public highway under the road traffic act and all laws relating to a public highway also relate to the carpark. only exceptions to this are private carparks on private housing complexes and private clubs, company carparks etc.

I was reversed into by a disco 3, i stopped as he was looking as if he was lost, he started reversing towards me, got about 20ft away he then sped up then hit me, (didn't see you there) i claimed on his insurance, when my insurance came up for renewal they loaded me even though i had protected no claims

Helps if you had witnesses, the other half got shunted in a carpark (she had pulled into a space, engine off, stood at the side of the car with her mother) woman opposite reversed out and hit the car square on and tried to drive off, needless to say missus turned into Tasmanian devil ( one of my cars and my insurance) as she knew what she would get if she didn't, insurance tried to claim 50/50 as there were no unrelated witnesses, took some sorting out I tell ya!

If you have her details, don't go through the insurance, just send her a letter before action with an estimate of the cost, if she doesn't pay, send another letter giving 14 days before court action, both sent by recorded delivery, then make a claim through the small claims court. It is then up to her if she trys to claim off her insurance. Legally your claim is against her not her insurance company, her insurers indemnify her against your claim. Do not enter into any correspondance with her insurers, always respond by replying to her or the liability will shift. Used this process many times when my company had a fleet of 35 cars, always with success.
