P38A Slightly OT - MOT question

Question for those that might know.
Took the RR to a garage I've used before (mots for the cars including rr) to have them resolve an issue with a binding rear brake (supplied the parts) and replacing centre exhaust. I asked them to remedy those issues and then MOT it.

Just checked online and they've put it through the MOT and it has failed.. Specifically on the brakes and exhaust. They obviously haven't carried out the work before doing the MOT. What annoys me is that this is now a failed MOT on record..when it would otherwise have passed if they'd carried out the requested work before the MOT which is what I asked for.

Is there any recourse for this?

There are several possibilities, try the Citizens advice first, complain to the DVLA or court action as a last resort.
Personally I wouldn't worry about the failure on the record as the record will show that it subsequently passed, the cost is another matter if you have to pay again.
 
What bugs me is that it looks as though I'm pig ignorant, putting a car in for an MOT with those failures. Anyone who knows anything about cars knows it will fail due to them. I don't get why they've tested it when I specifically asked them to fix the issues first before doing an MOT.

I always check a cars MOT history before buying and constant fails and passes put me off.
 
Is there retest fee?
Ask why they never followed your request if they had agreed to?
Then insist, if they had agreed to follow your wishes that they carry out the work as agreed and pay the retest fee on your behalf.

It probably helps their stats with DVSA. Looks like they are doing a more thorough job if they fail some older vehicles. I know a guy who will MOT test your car, then sit and wait 10 mins before putting it on the computer because otherwise he gets told off for doing it too quickly
 
Did it fail on anything else?... Here in the Algarve we mot our cars with known fails get a list and then repair all the faults....if you asked them to do specific repairs before mot thinking that was all needed doing in my opinion they did the right thing mot fail and then repair all faults could save on labour costs... Just my thoughts....
 
Collected it this morning and all fine. Didn't question them as I was running late. I guess, ultimately, they might not get many people who do their own repairs and maintenance so may well have thought I don't necessarily know what I'm on about.
