Prop shaft not there

I bought my Freelander in November as a short term measure to get me to work in the snow (my XJ is a bag of ****e driving in snow). I put it up for sale this week and tonight a buyer came to view it. He politely pointed out that the propshaft, err..... wasn't there. I felt some embarrassed. I'm tempted to drive it through the showroom widow of the shyster who sold me it... but I'm reasonable if nothing else.
This should be a very straightforward.... "Sale Of Goods Act".... not fit for purpose.... gimme my money back case.... shouldn't it.

Any and all help and advice welcomed.

It should be sold as fitted, as it's designed to be there, and part of the transmission, or you should be told it's not fitted before you buy. They remove the vcu and/or the props if there's a problem with the ird and/or the rear diff. Often it's the vcu that seizes up, causing damage to the ird and/or the rear diff.
 
First visit to see them only got me the monkey (typical wee Glaswegian nyaff in thick specs and flat cap) as the organ grinder had gone home.
"We don't dae refunds, mate" was the best this trogladyte could manage. When I told him he could refund me when I ask or when the judge tells him he said "Ah'll just tell the judge... aw ah dae is sells motors mate". I'm actually begining to spoil for a legal fight with these people. Think I might call the trading standards people too.

jesus!! fed up reading about freelanders for sale on ebay/gumtree etc about how great they are then"converted professionally to two wheel drive as more economical" bull****!!! converted cause theres a problem with the vcu/ird/diff, and too expensive to fix,always check the prop shafts are fitted on any 4wd not just freelanders,i had a close shave a couple of years ago with a td4 commercial at a trader in glasgow,lucky i looked under it,yeh no prop or vcu to be seen,he was well shocked,probably cause i checked!!!

Sounds like the place I went to view a car years ago - not surprisingly I didn't buy it:rolleyes:
 
Get organised and tell them about the fault. Ask them what they're going to do abou it. Get advice as stated above, and act quickly. Most garages will fob you off at first.
