As you know I have recently brought a P38 Range Rover.

Brought from a Trader only 2weeks ago.

It felt like the tracking was out this week, although it came with a 4wheel alignment certificate.

Took it to have wheel balancing checked which were all out and also the 4 wheel alignment was way off.

On looking at it the cars rear axle is twisted and the chassis looks amis.

I have called the Trader seller who has asked that I get a report done on the car and he will take it from there.

Full list of issues:

Rear air bags are about to pop looking at them, fronts not great either.
Axle twisted
in 2weeks the wheels have become way out of alignment
Large oil leak from engine, mid / bottom section (wasnt visible when we looked at the car initially).

Trader wouldnt comment on asking if a refund was possible but just said to get a report done and we will take it from there.

I presume I have to pay for report but can I claim this back?

Where do I stand legally if he starts to play funny with me?

Anyone know of some where I can get a report done asap, I want a full report of every detail on the car?

Fanatic is your man. he has link to the people who deal with this. You should take it back, You dont a report if the vehicle in your opinion is not fit for purpose. Send Fanatic a PM
 
Sorry Jay ..Don't mean to embarrass you but did you do a HPI on it before you bought it if you didn't do one NOW IF it comes back as "dodgy" take it back to the trader & tell him your going to sue him under the trades description act & also remind him the vehicle sold was NOT Fit for Purpose!!

If the Back axle is that far twisted it MUST have bin a Cat C or higher making it unusable on the road WITHOUT a VIC check.
 
Yes full HPI check came back clear, so if it has been in a crash it wasnt registered.

Do I drive back tomorrow (trader dealing from home) and request my money back, do I warn him I am coming so he has the money available if he will offer a refund.

OR

Do I do as he ask requested and get the report done to see the extent of the issues.

When we brought it, and it was freshly aligned the twin exhaust pipes were level, over the last 2 weeks and as the car has started to crab the exhaust tips are about 2inchs uneven when looking at it.
 
Okay after our chat as agreed I would post a copy of what we discussed.

1) A4 pad write all details so far and time and dates etc - keeps important details fresh, stick to facts only written down eg.

11:05am 13/11/10 contacted mr blogs at daily motors and explained the following issues with the vehicle.

Mr Blogs said bring the vehicle in on 15/11/10 at 16:00 for him to inspect

2) Contact Consumer Direct (trading standards and free legal advice all on one number)

3) phone VOSA national helpline and explain you believe that the vehicle you have purchased has a dodgy mot and you believe that the defects were there at time of MOT.
They should log your details and give you the local area office number-VOSA should offer to look at vehicle and you will have a vehicle report.
(As far as I remember inspection was free or a nominal amount)

You have my sincere sympathy, as from the description of the vehicle it sounds like it has severe structural issues (obviously I haven't seen it)

Many thanks for our chat and the info you have provided.

I have written down the dates as you suggested and the conversations I have had with the Trader.

Monday I will contact MJA Landrover and M&M landrover, these are both my local specialists I will get prices for an inspections covering all elements of the car and any defects.

I will also get in touch with VOSA re the MOT and that I believe the issues were present at the time the MOT was issued.

I take it a twisted Axle / chassis damage would be an MOT failure???
 
Before paying for an inspection go the vosa route as it will be the undeniable inspection and they tend to have massive leverage with rogue traders in conjuntion with trading standards- i.e. refund or prosecution.

From the description it sounds like the chassis has been twisted and is weakened, normally a bodyshop jig would straighten permanently.

Without seeing it it sounds like a major structural integrity issue and the fact you have lost wheel alignment and the other issues listed.

I'm also dubious that the trader knew of issues as he didn't express concern and offer to look at any of the issues.

As per our discussion it sounds that the vehicle is not of "satisfactory quality" and "fit for purpose"

I know desperation to resolve it sets in, but the route I suggest is really the best way-as it gives it report absolute authority and hopefully means your not involved in a long winded court case and great expense

Correct, make sure you say "you believe that issues were there at the time of MOT" and you believe you have been sold a car with a dubious MOT.

The reason you need to imply the issues were there before and after MOT test date were because
VOSA only interested in MOT day and
1 Months Mechanical
3 months Corrosion

But vehicle must still be kept road worthy.

That said you want them to ask to look at it for you, because a vosa & trading standards threat of prosecution=99% chance of deep **** for trader as judge will class VOSA opinion as expert witness

:welcome2: as I said on phone it can be extremely hard not to become emotional and remain calm. But on a plus side your a step closer to resolving the nightmare.

Be and objective -it's one of many cars

1) Follow the process we discussed
(my phone manner not the best, my apologies for sergeant major style)

2) Depending on what the outcome is you may be presented with option of fix or refund , fix & partial refund -personally if you have had **** customer service the refund is way to go.
(you don't want more dealings with a dealer who won't even look)

3) Consider after the current agro if you got a refund -maybe asking one of the regulars local to you to cast an eye over a future purchase
(even if you need to bribe them with beer/food or cash).
Or RAC or AA inspection

4) if they repaired it satisfactorily then again a result.
