MOT Fail - Steering Lock

My Disco has just failed its MOT on Steering Locking Device insecure (2.2.C.1g). I've taken the plastic covers off and all I can see is that the lock barrel rotates through about 10 degrees when locked and the steering wheel is turned. Once unlocked the steering operates OK. The only thing clamping the locking mechanism to the steering tube are the sheer bolts - which may have sheered at a point to early to get a tight enough grip??? I could try and get the MIG in there and weld the clamp to the tube - but that might make problems in the future if the lock needs changing. The operation of the steering is unaffected by this lock moving (in the locked position only - should this really rate as an MOT failure?:confused:
 
under new mot regs I think you will find its a fail if insecure, wich yours is you say. dont have to be sheer bolts ,if you can get old ones out fit normal bolts so its secure.
