i think it was just an arse covering exercise on the testers part. at the end of the day it was only an advisary and you were entitled to discuss it when you collected it. he could have noted it as dangerous because its at a height that is easy to touch and it could be hot? (just a suggestion)
 
I had a problem once with a vertical exhaust stack on a slitty for mot, the probe only just reached up to it, another couple of inches higher and he said he would have failed it.

Cant see how he could really :rolleyes:
 
The law on tyres is no tread visible beyond the arch. the wheel rim and side wall may be visible as may these chavvy "overstretched" tyres (so long as the tread int visible) that the saxo/civic tossers have on their super fandango wheel rims. So ya fooked if yu've got special tracks fitted and they protrude even 1mm past the wheel arches.

I always understood if the tester can not get his probe in then he can't fail it. If it can't be tested it can't be failed?
 
exhaust will be as its pointing to the kerbside and could cause offence to pedestrians, if it belches out a gobful of smoke when pulling away if you have been stood also it is a danger to small children if they are stood near enough to it to get burnt..If ya tyres are sticking out any he could have been a full on cock and merely failed it..not advised it. stop complainin you got the ticket lol

Many large trucks have huge exhaust on kerbside at toddler height, admittedly not pointing directly to kerb but very hot gasses pumping out, some buses have a dirty exhaust on nearside rear and they are not the cleanest of vehicles since de-regulation, where do you draw the line??
 
Report him to VOSA, clear regulations stipulate that the testing officer must not offer any personal bias as to intimidate the customer or influence the result.

might not be such a good move , as the man from VOSA might decide that he should have failed you :cool:
 
And therin lies the problem Eggsauces are supposed point to rear or vertically upwards. once ya start sticking em out the side you start to infringe on C&U regs.

remember thee square headlight v round headlight of the 80's or for that matter Iveco side exhausts etc

Sound a bit keen but better than the examiners that give vehicles clean bill for the regulars prior to them selling the vehicle, which has happened to me.
 
My TD5 90 exhaust points out the nearside behind the rear wheel. Its how LR designed it and as they got type approval before being allowed to sell them I dont see how any MOT tester can have issues with it.

..as do most Land Rover Defenders, it's no smokier than normal - only a bit higher than a standard outlet.

Both points centre on apparently pointless interpretation of 'Advisory'

I have no complaints, I have my ticket - but goes to show how unclear the standards appear to be to a man in the street.
