The Consumer Rights Act 2015 requires dealers to supply goods that are fit for purpose, as described and of satisfactory quality. Its the law, and as a dealer, they should know it. You are perfectly within your rights to ask for your deposit back.
I agree, in essence, but if it has a brand new MOT, and it starts and drives, in court the dealer would simply say, "What is the problem?", so fit for purpose and of satis quality is a bit dodgy
HOWEVER, it is described as a 7 seater which it ain't and with that he has them by the bollox as that comes under the Trade's Description Act or whatever it is called now. AND as a 7 seater, it isn't fit for purpose.

Let’s hope not. Hopefully he sees this as useful advice from people trying to ensure he doesn’t end up in a financial black hole not anyone having a go. I do miss my D2, find a good one and they’re a very handy thing to have around.

I miss my D1 more than my D2 but my D1 was an ES :D
Don't miss welding the F@@ker every year though. Got rid of the D2 before it needed welding but would probably have kept it if was a higher spec model (it was a GS).
 
Odd that it’s still covered in snow for the duration of both MOT’s preventing much of the underside being seen. Very inconvenient for the tester.
Where have they kept the fecker, in the fridge-freezer?

D1 was an Argyll, should definitely have fixed and kept that. D2 was an ES Premium, sold that for the right reasons at the time but still miss it.

I'd like to take the leather seats and manual gearbox out of my D1 Anniversary and put them in my D2 GS, and it's chassis! and If the engine plays up anymore, the 300tdi!

Sounds like it would be easier to put some D2 bits on your D1 :D
 
It gets worse, they are starting to rot as well now!
D3 is ok up to 07 then its gets a bit more techy, d4 onwards very techy and d5 and onwards mega techy.
I had heard that although it is of only academic interest to me!
Maybe OP has got bored with us as the thread has wondered a bit!
