Do not rush into anything. Find my thread on 'MOT and then some'. I had loads of help from the guys on here, and ended with a satisfactory result. Just remember when dealing with insurance companies that they are not your friends (even yours) they are business that only want to earn cash.

Update.

Witness statement received by my management co. and they have my photos now. They seem to think that he will hve to admit liability now.

I hope so because I can't stand this Chevrolet Captiva. It beeps at everything.
I went to the shops to buy some milk. It beeped at me all the way home. I had no idea what for. Worked it out. The weight of the milk made the seat think someone was sat in the passenger seat with out their seat belt on.

Suppose I'll have to strap the milk in from now on!!!
 
Good luck get it sorted mate, make sure you hold out to get what you want. It's like a double whammy kick in the nuts , landy off the road and stuck driving a Chevrolet!!!
 
i had exactly the same sort of accident the other week mine ended up a total loss

chassis was twisted on front driverside leg
front axel bent and wheel destroyed
radius arm bent and also pushed bracket back where it mounts the chassis
wing destroyed
all the steering rods were bent or ripped from the chassis

landy was valued at 5k cost of parts and labour to repair was more so it ended up a total loss it had a Galz chassis already

insurance valued it at 800 if i wanted to buy it back as a cat D and repair myself plus there admin fee of 160 and

Yours sounds worse than mine. I was only doing 30mph.

When I looked it was just the bent radius arm mount but it probably has bent the radius arm. The track rod is def bent but the drag link looked good. Chassis has a crease in just before the radius mount. Wheel looks to be okay - Don't know about axle. Complete front o/s wing need with side light and indicator. Headlight survived?????
Rear corner got a scrape as well bending the corner post a bit!!

Just have to wait and see. Did you buy yours back???

i was doing about 20mph but mine was head on crossed with swerving to get out the way !!!!

i didnt buy it back i had not long had it totally restored and didnt have the heart to invest more into it and it still carry the Cat D name after

looking at the landy you wouldnt of seen half the damage untill i started taking a good closer look
 
Thats what I feel about mine R.e what damage have I not seen!!
I was recovered and when I got home I had a quick look. Then It was taken away and I have not seen it since.

Depending on the value I may buy mine back but I will try and barter no cat or at least a cat c. I put a lot of time into it just to say good bye.
Besides - they will only crush it and that would be criminal!!!!

Update :

Today I received a letter from my personal injury solicitors stating that
the third party has excepted primary liability for the injuries.

Surely this means they have for the accident as well - Lets hope so!!

Yes it does, ensure that you get the maximum value for the vehicle. One issue that I didn't consider was buying it back as a cat c or d write off and breaking it; keeping bits I wanted for a new one and retrieving some funds via fleabay.

I had not considered that either.
My option was to buy back and repair with a new chassis.
Only prob with that is no car while repair done and the transport for a non driver would be at my cost which I'm sure would be a lot from London to Lincolnshire as thats where I would possibly want it repaired.
It's such a hard descision with so many factors.
If I get a replacement will I end up doing stuff I've already done like
Rear crossmember
Gear box rebuild by James Martin
New LT230 disco transfer box
new steering box
new front calipers and discs
New front brake pipes
New lift pump
New vacuum pump
New windscreen
Lots of welding including the both bulkhead outriggers!!
All track rod ends
New drop arm balljoint
Head gasket done
I'm sure there is more and thats all in a year and a half
Oh and new clutch and rear oil seal.

And none of this is my fault!!!!!
 
I know the feeling - I have a Richards chassis which was rebuilt by Gumtrees. I wanted someone else to check all the other bits as it was being done, also it was done within a week. Part of the settlement money was to cover TREs, bushes etc.

I had to remind my insurance company several times that they worked for me, when they argues I said that I had been mis-sold the policy and wanted to know how to complain. Once I finally manged to deal with the manager, it was all sorted.

Most of the time you are dealing with some ignorant spotty oik who could not give a toss and just wants to get off home and make love to their xbox all night. As you say they need telling that you are paying them so they will do your bidding or be in breach of contract and guilty of taking money by deception or fraud. After all you insurance policy is a contract enforceable in the courts by both parties to the contract. As most fully comp policies carry a legal expenses element that is provided by a separate third party you can also turn them against your own insurers if necessary. My sister had virtually instant success when she did that.
 
Curry stand your ground they are waiting for you to be weak and give in. Don't be a pussy with them get hard very hard stand your ground and you will win. Your defender will be in better shape than before the accident and last for another 30 yrs, at least the new galvanized chassis. The longer it takes the more it cost the insurance company. There have been a few on here that have had there pride and joy and back on the road again in better shape than before.
