Must just be my local tester who has to check for tampered CATS and blanked EGR? That's the change that has caught older oil burners.

If you don't tamper with your cat and don't blank off EGR it will not fail will it. EGR on the P38 only came in at MY 1998. Diesels are tested for smoke output only. They don't produce CO2 to any extent. Have you ever been an MOT tester? I have.
 
Unfortunately a lot of peeps did tamper, especially the 4x4 brigade. Soz, don't play "my dangler is bigger than yours." I take it your not currently a tester?

The approximate CO2 per litre of diesel fuel is 2.68kg, and for petrol it is approximately 2.31kg. LPG produces around 1.51kg per litre.
The key with diesels is that they produce less per kilometre.

Older diesels are tested for smoke not for CO2 output.
