Blimey i cant win, took my lab out the other day for a nice walk , she has a collar on and put one end of the lead through the metal bar on the cage( commercial ) then clipped the other end on her, tested it to make sure it could only reach to the rear window.
Then when i go along i can lower the rear window for her. well sorry for gassing there i am going down the road then see blue lights behind me, i pull over and he asked if i knew why he had pulled me over, me replying no.
he advises me that having the dog at the back with a window open is a destraction for other motorists and could cause an accident of then hitting me up the backside.
i have always made a point of being polite to the police as i know they do a tough job , but did struggle a bit with this.

i informed him i wont do it again and will put the window up, he had a quick look around the car and candy came to the back window and he got caught with a huge slobbering kiss from her.

any suggestions, i know i took all the required precautions of making sure i had a very stong lead attached to the dog guard and onto her.

she does not chase cats etc so i know she wouldnt jump out but clipped her just in case.

they say they comes in three's, wonder whats next,lolol

From what I recall about the Construction and Use of Motor Vehicles act (vague and distant memories that they are) I don't recall anything specific relating to your run-in with the Rozzers; personally I would suggest that the Constable in question may have been having a 'quiet day' and perhaps over zealous.

The fact is that the rear window has been manufactured to wind down and so the vehicle was being used in an appropriate manner consistant with its construction. Additionally anyone who has been in the countryside will have seen scores of soft-top Defenders with dogs in the rear (unsecured) or even the odd sheep or two - again, no offence taking place here either; in the same way that a dog putting its muzzel out of an open window while a vehicle is in motion.

Had your dog been lashed to the roofrack I could see a possible offence; but as it is...
 
what a load of ****e!!! i to have a lab and jack russell in the back of mine and allways have the window down for them and allways will,infact the drivers behind chuckle when the jack pops his head up at traffic lights!lol,i used to hav an open top series 3 which again the dogs wondered around in,i think if it was me and knowing my car is legal i would have stood me ground and politely told him to sod off!! Its not against the law because it is factory standard that the window goes up and down.I bet they wont pull the wags over in there merc/bmw convertables with a pavement rat hanging out there handbag!!!lol......think of your dog and keep the window open! wet lab lick!!nice lol
 
wonder what they would make of one of our local gamekeepers going round on a quad bike with 2 black labs, one on the front, one on the back.
 
sounds like a crock of **** to me matey. I doubt they would be able to pin much on you other than breach of peace, I don't know of any specific driving laws. Probably having a bad day...

It would be there fault if they hit you from behind, no questions asked. I think it was 'friendly advice' lol
 
should of simply asked him if you were committing an offence......if not as long as your happy the dog is safe you carry on about your business whether he likes it or not.
 
Does that mean if you had kids on the back seat with the window down and they pulled a face at the car next to you while you were overtaking you could be arrested.....
 
What a crock..... A quiet day in your area for the police, and another example of bad police p.r!!!

Get the feeling that most Land rover owners would be looking at a minimum of a public order offence.. not just breach of the peace!!! I know I would.
 
You were obviously the Black ball in their game of snooker. Countless farmers/landy owners with Ifor Williams hardtops/trailers must be quaking in their boots when this "law" came out...

Better get the dog checked out at the vets...........she may have caiught something.
 
On a vaguely similar vein It always amazes me how many morons there are out there that let their dogs stick their heads out of the side windows. You only have to count the number of bugs that get splattered on your windscreen. or the number of times a lump of gravel gets fired up by the car in front.. and try to correlate that to the amount of debris that goes down the sides of ya motor. And then tell me why they would let the pet (they allegedly love) stick it's head into that debris/insect stream with the potential damage to it's eyes.

We have two dogs, and frequently tie them to the luggage straps in the back with the rear window lowered, but now that the summer is here we have the roof down...am i committing an offence? Dont fink so.
Load of bollocks.
 
When my Border Collie's in the back/boot of the Disco, the rear window's are down as he loves the breeze and whatever smell's drives him nut's ... if I had a Cabriolet he'd no doubt have his paws on the dash and head held high, I don't think I could stop him, be it fly or chipping's hitting him... that PC was probably bored stiff or fresh out of college and eager to test the obscure law's he's just learnt:doh:
