Had a non fault yesterday with my series 3 , guy came out of a junction full on and hit side of me , unlike some I'm not faking injury he was an old fella so I'm not taking the **** , by time I had gotten home LV (his insurance) had called , he accepts full responsibility and his insurance are paying for the lot without me even notifying my insurance !!

I've already been to their appointed repair centre who coincidentally are a Landy specialist and its mostly damage to the bottom sill however it has forced in bottom inch of doors . My question is this ....

The paint on that side was pretty awful , if they respray bottom of doors they will surely need to respray the whole of the door and rear side panel so it matches , is that right ?? Also door top is approx 1/2 inch from frame due to the rot , it wasn't perfect to begin with to be honest , will they poss replace that thinking it was due to collision ? , if not can I claim as I'm sure collision made it worse , The insurance guy couldn't believe I wasn't claiming for injury so I think they just want to get on with it before I change mind !

At the end of the day an insurance company is only required to return the vehicle to a pre-accident condition & is not even required to use brand new components (though the replacements must 'fit for purpose') One possibility is for you to agreed a deal with the repairer to rectify some or all of the existing problems whilst they are already spraying your car, thereby saving you time & materials. As to the problems caused by corrosion - what do you think ?

How do you know you're not injured if it was only yesterday, I have a colleague who settled early as they thought the twinge was nothing but now have debilitating neck pain and can't claim.

The only way your colleague cant claim I if they signed paperwork saying that they wont claim.
If they havnt then they can still claim.

As for the OP.
Have a word with the repair company to see how much extra it would cost to paint a bit more than the damage.

Let's be honest. The garage is probably rubbing his hands together. He could replace the sill and the door and still quote cheaper than a headlight and wing repair for any modern car.

I had a non fault in my D2 about a week after the OPs accident! Similar type of incident - the other guy drove into the nearside - he'd crossed the give way line at the junction, admitted liability. Incidentally the other party's insurers were LV..

Got the payout last week. Net effect is same as buying a D2 for £200 ;) Difference is, my D2 was written off cat C or D (I don't actually know)! "Uneconomcial to repair" Authorised repairers estimate was £4k - Brand new complete doors from LR plus fitting & spraying will probably cost that much.... Anyhow still roadworthy, just got an MOT (dented doors don't fail if there's no sharp edges, projections and they're not loose), awaiting the appointment for a VIC to regain fully comp status on insurance.

I have had a cheque from insurance this morning , my landy isnt written off in any category , my insurance havent even needed to be notified.
the repair is a new sill and brackets and a respray on the one side , the cheque amount ............... £1850 ,
His insurance didnt want to pay the garage to get repair done , I suppose after mark up , labour and car hire its just easier for them to write me a cheque.

check your t&cs. i'm pretty sure you are meant to notify them or they'll void you. also your premiums will go up now :(
