My Garage does the disputes for these sorts of things for trading standards - Depending where you are in Essex it might be wroth it - it is in Rochester, Kent. I had a landcruiser from a dealer wth the same issue - purchased it, took it in for a check and it was a complete fail. The mounts connecting the body and the chasis were completely gone. Worst thing was the the MOT was done at a Toyota dealership. It was very stressful and had to threaten to take them to court. My garage were great in writing in their capacity as trading standards verified centre for resolution. Got my money back. thankfully. PM me if you want their detils

Dont let him take the car without giving you your money back first, he could do anything with it

Thats exactly what I've told him. Just wasn't sure if I should allow him to or not.

Compromise, ask him for the keys to his house and live in it till he pays up for the motor

Tell him you want the cash now, but promise him that you won't spend it for 30 days!

He wants to sell the car before he pays me back! How can he do that anyway, he doesn't have the log book?

Log book is not proof of ownership, only registered keeper.

I personally would not agree to letting him try and sell it before he refunds me, if it was my problem.

    Cheers

Yes but surely the new owner is going to want the V5? I don't intend on giving him the car before the refund. Just couldn't make out how he thinks he can sell the car without the V5?

Car could mysteriously disappear whilst in his possession, and so long as he has taken reasonable precautions against it being stolen he is not responsible, you then have to claim off your insurance.

    adding to @johnlad 's post,

Make sure that as soon as you hand it back and get the cash, cancel your insurance.

    Cheers
