Rear Seatbelts

My 110 hardtop came with a two person folding bench seat in the rear. It has a seatbelt fitted, but one which runs the length of the seat, and will only allow one person to sit and wear it. I'm a bit dubious about it's safety.
So - whats the legality of rear belts? As I understand it, I don't need passengers to wear a belt if it's not fitted? But then, I don't fancy being hit in the back of the head by a fat mate - so whats the best way of fitting a belt?
 
its a stupid rule the fitted seats thing. if you fit sideways facing seat urself you dont need seatbelts. this is because if you have a strong sideways impact whilst wearing a seatbelt on a bench seat, your spine will be ripped out of ur pelvis and you will die.
