just changed my gear oil and filter, book says it needs 9.7 liters of gear oil, filled it up with 8 and it was full to the top of the dipstick, why is this, run it up went through the gears and took for a drive, dropped a bit but still way over so dropped a few out. but why was it full to begin with???

any ideas

9.7 litres is dry fill. You do not need as much to refill after drain as torque converter has oil in it.
 
recommend that you drain some fluid out and get the level right. Overfilling can cause as many problems as running low.

As has already been said, you cant fully drain the system during a fluid change as the torque convertor remains full. The only way you would need the full amount is if you dropped the gearbox out and stated from scratch.
