hang about - he's signed a contract (i assume for 12 or 18 months) and missed a number of payments, so on what grounds will he be able to get out of that contract on the basis it is they (O2) who are in breach of that contract ?

am sure there will be some small print in that contract that says somethings along the lines of "will will cease service provision if you dont pay"

if you've signed a contract stick to the terms of it by paying, or if you want out of it pay their cancellation fee and get a PAYG phone

Ahh but the way I read it. he refused to pay because of an over charged bill and therefore the payment was in dispute so should have been frozen pending resolution of the dispute.

Phone companies are blatant arseholes. Which ever way you go, unless you are 100% sure and documented that they are in the wrong, they'll **** on you from a great height unless you pay off the outstanding contract. I have 3 contracts with O2 and not had a days bother, it's purely luck of the draw. I would consider advice carefully as a mobile phone payment default and contract closure will look nasty on your credit report for the next six years anxd you'll fight 'til your blue in the face to get them to remove it.

Best thing is get onto their complaints line and get an email/letter off stating all your grieviences and demand some form of compensation for all the inconvenience they have caused you!

Cheers Pikey, exactly. :D
And if they're charging him repeatedly for their own mistakes then they're breaching the regs.

If they wont be reasonable tell them you are talking to Ofcom & Citizens advice B. O2 are expensive, Orange are Customer dis-service that's why I'm Vodafoning.
My favorite phrase to talk to someone who can make a decision is.. "I want to speak to your manager." They'll run around like crazy to stop that conversation.
Good luck.
