I've just joined up, as I've been looking for info on Rooley moor road,and spotted it in this thread.
I was driving (slowly and sensibly) up rooley moor road on bank hol.monday afternoon ,from rochdale end,when I was stopped by two cops on trailbikes and one in a plain car. I was told that it was illegal to drive on there and was given a £30 on the spot fine!! for driving 'elsewhere than on a road'. and warned that my disco would be seized if i was caught anywhere near again.So i had to drive back down the way i came,tho i was nearly at the top!
I dont know the current legal status of the 'road',but would be interested if anyone does know for definate.

So be warned ,If you're planning a trip up there soon.!

I missed the day at cowm quarry ,got there when everyone was leaving:(
It looked a bit dry up there though?? but could see everyone leaving had found some mud ! ;) .
 
I have been told that this road has been classified as an ancient highway, so is legal to drive.
The owners of Ding quarry got the road classified as such by taking Rochdale council to court.
Where abouts did they stop you Slimbob?, i know you say near the top but anymore info?

I was just at the point where you can go straight on ,over the top ,or left to the quarry(?) I think.Iwas on the cobbled road not on open moorland. Thought about appealing ,but wouldnt trust the plod to tell the truth in court I'm afraid.All they would have to say was that I was on the moor not the road ,to justify the ticket.
I think the letter of appeal gets read by a judge and then decide on it ?
So if it is legal to drive on an ancient highway(not just on quarry business) then there shouldnt pe a problem as far as i can see,and its pretty straightforward and obvious that i shouldnt have got the ticket.
Only got a couple of days left to decide what to do ,,aarrgh:mad:
So If you can tell me for absolute certain ,please do:)

This might help it's the quarry owners planning application in which they describe the road as an ancient highway http://www.dingquarry.co.uk/upload/userfiles/file/pdf/Non-Technical Summary.pdf However a quick look at memorymap shows Rooley Moor Road to be a Bridleway. So if it is then I'm afraid your stuffed
 
Hello.

A friend of mine travels this road from Stacksteads every otherday to get to work and he is adamant that it is 100% legal to drive.
But he may be wrong, the guys on Difflock.com claim it was changed under NERC and is now a bridleway.
But it does say on the NERCA webby that if you can prove that the road was used to carry Motor Propelled Vehicles before 1930 then it can still be used for that.
I spoke to another friend of mine and he says that up until the mid 70`s there used to be a pub up there.

I PM'd Slimbob with a few links that state Rochdale council have accepted it as an Ancient Highway in 2003...perhaps with some pressure from the owners of the quarry but still a legal process and decision.

I must admit that I've been bombed the last few weeks...my family is becoming VERY familiar with the concept of Chemotherapy, (not because of me I hasten to add), so I haven't gripped Plod yet. Worry is the can't tell what consitutes a daytime MOT so the finer points of an Ancient Highway..well...let's say I'm not hopeful of a consistent answer.

I will keep checking but may take another week or two. :eek:

In 2003 Rochdale Council was pressured by Chester-based solicitors to declare the stone setts and bridleway of Rooley Moor Rd an “Ancient Highway”. Such a quaint title may give the impression of historic legal status. It doesn’t. Quite the contrary- in fact this legal ruse under the Highways Act stripped the Cotton Famine road of some protection: As a highway, Rochdale Council became legally responsible for its upkeep and certain provisions under the Wildlife and Countryside Act became more difficult to enforce. Motorised vehicles had a re-established right to the highway. The planning application specifically cites this route in its desire to transport up to 750,000 tonnes of stone a year for the next 30 years.

Although I don't like to quote in this way...this could be incorrect of course...the site is effectively trying to STOP access to the quarry to protect the habitat...so you'd guess they'd be cautious about publishing such information.

There are other references too. Just gotta find the right people to ask for an honest response! :rolleyes:

Am in Canada right now in B.C. about 150km from the 'Whipsaw trail' one of the BFG outstanding trails,in north america.was an article in LRM a while ago. Unfortunately i havent got a 4x4 to drive ,cant get insured for inlaws new honda thing,and doesnt look like it would be too tough offroad ! have got a girly mazda mx5 to drive:( (the shame....!)
Seen some gnarly old pickups over here:cool: and a few old discos so far .
