Are the rear seats side facing bench seats or fixed forward facing ones? If the latter it says there you can apply to TFL for exemption. Obviously you’ll need to fit them first, or send an older picture with them fitted. If they are side facing bench seats then you have to pay.

Best give them a ring regarding your recent use and penalty notice and explain your situation. See what they say.

LEZ is expensive and mine is subject to it so when I drive near there I have to plan a route around it.
 
I haven’t ordered the seats yet as I haven’t finished the interior works. I was planning on purchasing 4 of the the individual seats in the attached photo. Although they are side facing, surely they class as ‘individual seats with seat belts’ and therefore I’ll be exempt?

You’d have to send them a picture and ask. If your buying the seats then to-date you’ll be subject to LEZ so likely have to pay for your recent use.

It’s only intended to be station wagons that are exempt, yours looks like it was a commercial 90 hard top which has after market side windows fitted and it sounds like it’s either not had seats before, or had bench seats fitted?
 
also if your defender didnt leave the factory as a station wagon, i.e it had panel sides and was a commercial type variant and was later converted, then you may not have any joy
 
Evening All!
Need some help/advise. Just received a penalty charge notice for £250 for driving in the Low Emission Zone in London. The charge is from back in Feb when I bought my Land Rover 90 (1987). This is a worry because I have been driving my LR around London for the past 6 weeks without knowing it doesn’t meet the LEZ requirements....I am therefore expecting a **** tonne of penalty notices to come through my letter box over the coming weeks...
My Land Rover has 3 seats across the front, rear side windows and a window in the back door. It currently does not have rear seats/benches as I’m currently sound deadening the interior but it is obvious there have been rear seats/benches in the past as the fixing points are visible. I believe my V5c states the vehicle is a ‘Light Utility 4x4’.
I’ve been on the TFL website and have found the extract below regarding Land Rover Defenders and LEZ...
What do I need to do to make my Land Rover compliant as it isn’t a commercial vehicle? Thanks in advance!!

“Land Rovers

We have worked with Land Rover to establish which vehicles with the body type of 'Light 4x4 Utility Vehicle' are subject to the LEZ. Vehicles manufactured before 1973 are considered to be 'historic' vehicles and are exempt from the LEZ.

The vehicles listed below are subject to the LEZ standards:

  • All Defenders; 88s, 90s, 109s, 110s, 127 and 130s (except station wagon variants see below)
  • All Defenders manufactured with 10 or more seats including the driver's seat
  • Freelander Commercial
  • Discovery or Discovery Series 2 Commercial
  • Conversions (eg ambulance, motor home)
The following vehicles are not subject to LEZ as they are classed as 'estates':
  • Defender, 88, 90, 109 and 110 station wagon variants up to nine seats inc the drivers
A small number of Defenders 90s and 110s may be a 'station wagon' but may not be classified as such by the DVLA. This means vehicles with side and rear windows manufactured with fixed seating throughout the vehicle including the area accessed via the back door and there are nine seats or less including the driver's seat.

Vehicles without fixed seating throughout will not be treated as an estate and will be subject to LEZ. Fixed seating means individual seats with seat belts. It does not include benches or homemade seating variants.

If your vehicle meets this criterion it will not be subject to the LEZ standards. In these circumstances if you intend to use the vehicle in the LEZ you need to:


  • For models registered from 1998 - correct the body type description, vehicle model details and/or number of seats with the DVLA and provide photographic proof
  • For models registered before 1998 - register your vehicle with TfL with suitable photographic proofs showing all sides of the vehicles with all doors open which clearly shows the entire internal seating arrangements.
If you have a Land Rover not listed above, contact us to find out if your vehicle is subject to LEZ.”

Unless it was originally registered as a Station Wagon, you cannot make it LEZ compliant.
If it says Light Utility 4x4 on your keepers document, it cannot ever become LEZ compliant.
And no Ninety/One Ten, or any Defender, is ULEZ compliant.
