ive been having a few discussions with my insurance people as in previous post someone hit the back of my disco along with a few other cars my insurance recons i will have to claim with my own insurance as his insurance people will say that he didn't know he was going to have a heart attack and crash the car and die (from his heart problem) and say it is an unforseen accident. but my stance on this is i didn't know he was going to crash into me cause if i did i would have went a different route and also last time i checked aint all accidents unforseen. so i have told them under no cercumstance am i going to except liability. so has anybody had this problem
 
They are ****ting you, do you have legal protection?-if so go for uninsured loss.
Speak to citizens advice or solicitor. wtf should you loss ncd for someone else-classic can't be ****ed insurance company you lose your ncd and they collect your excess

if you have a heart problem you have to tell your insurance co about it i would have said for this reason but with this you need to speak to some one professional insurance ombudsman maby or solicitor you need advice and will have to pay a bit out for it but you need to beware of what things can cost insurance cos. are to big to fight unless you have big pocketts but the threat (has worked in the past) can work
 
Or phone consumer direct, classic insurance stitch, they take your ncd and cash for excess-because they decide it's easier-certain insurance company tried it with me.

Consumer direct put me straight, told ins co didn't want to claim but go for uninsured loss-failing that I'd go to ombudsman=they played the game.

Notwithstanding the deceased's medical situation, the whole principle of Third Part Insurance is to cover other people's losses through your own actions/inactions.

A word with solicitors or legal people would put you right, we pay £7 a year for legal expenses cover on top of our basic premiums, at work and at home.

It was a successful defence to show that a 'mechanical failure' was unforeseen, but I believe that has been overridden in the 1970's by a judgement in the High Court. The Third Party Cover has to be effective in all cases.

thanks for replies i have warned my insurance that i will take it to ombudsman and i have seen the guy in the union at work so i can use there solicitor if it needs to go any further i have paid legal fees for my insurance but im not sure about using them as a friend of mine used his insurance legal team last year and they set him up like a kipper to get the case finished quicker someone stepped out in front of his car trying to cross a major road and he knocked him over and killed him the guy just left the pub with his brother police charged him went to court his solicitor told him to plead guilty to garantee a slap on wrist he got heavy fine and lost his licence he then spoke to someone else and they told him that he was badly advised
