Advice on V5 when purchasing

Hi,

I purchased my landy a few weeks ago and the bloke i bought it off was not the name on the V5, nor the address. I only noticed this after when the V5 came through with me listed as the new keeper.

He did mention he was in keep of the vehicle due to a part exchange, so i am wondering how this works as he signed the V5???

Any advice on this would be great as he has sold be a dud vehicle that is not road worthy

You have been scammed. He knew it was a dud. Irrespective of the V5 he contracted with you. If you want to get your money back n return the vehicle you have ever right. What is wrong with the landy?
 
In what way has he been scammed ? the name on the v5 doesnt have to be the legal owner (it says so on the v5)

If he took it in px the guy you bought it off may of signed the yellow part (motor traders) and sent that to the dvla (not sure if a non registered trader is supposed to do this but it happens)

If the dvla returned the v5 to you and the police havent been to your door i wouldnt worry as it cant be registered stolen

what is right with it would probably be easier to answer hahahaha.... basically within 48 hours of collecting the vehicle the handbrake failed - serviced and put right but told then that the exhaust had been puttied since MOT. since then, electrics, battery, potential head gasket problems and been advised not to go on long journeys, potentially need a new altenator as battery keeps dying, driverside window, also leak when it rains driverside, engine had no oil when i drove away and i didnt check it because i stupidly assumed there would be oil in the engine,

bought as a trade sale, receipt shows business address, but seller is now saying it was a private sale ad he was using it privately for a few months, eventhough the log book states the previous owner was someone different at a completely different address, a few towns over.
He has basically told me to do one today and to only contact him through a solicitor, citizens advice have advised probably not much can be done as i have had the rover in my possesion now for nearly a month.... im kind of unsure where i stand with it as if he claims private hes covered but trade im covered (kind of) if i take it to a small claims - life story.... im sorry .... any thought on this would be amazing as its currently sat idle because i dont want to spend any money on it as iv already spent a few hundred in its first week.....

thanks for this, i had a feeling it was kosher as i hadnt had anyone knock, just wodnered where i stood if it was at first a trade sale, and then when everything went wrong with it and i advised im coveredby the sale of goods act under a trade sale he told me it was his run around for the past few months and was actually sold privately??? my receipt shows a trade address???

How much was the car ? if it didnt cost much id assume the potential cost of taking him to court wouldnt be worth it (even if you won damages they cant make him pay if he doesnt want to unless you then go to high court)

Having said that you should still have some comeback even in a private sale
 
thanks for this :))) solicitors have said not worth it ... waiting to hear whether moneyclaim have any advice on it....

to be honest it is a life lesson - it didnt cost much - but money i dont have to spare as needed the care for employment opportunities .... so safe to say i know now what not to do when buying a car .... silver linings and all that :)

Always best to take someone with you you're not that good with cars

I saved a woman from work from buying a knacker recently on an 09 fiesta ( Ex mechanic so I seem to always get the car query's) , car looked good and she was all up for buying it but the release bearing was screaming its tits off, she just thought it was normal background noise

potentially need a new altenator as battery keeps dying, - all these are probably related. If its a duff battery it wont charge right, if the alternators duff then ... well it wont charge!

driverside window, also leak when it rains driverside, - cable kit is a a tenner and is easy to do yourself at home, where is the water leak? as your profile pic shows its a hardtop, it could just be the clamp needs adjusting to pull it tight

engine had no oil - does it have oil in it now? it obviously had some because otherwise you wouldnt have got home.

potential head gasket problems and been advised not to go on long journeys - could be any number of things, from something silly like the header tank cap, waterpump on its way out etc, which "could" damage the head if it hasnt already. Ive had mechanics tell me head gaskets gone on 1.8's before when there was nothing wrong with them and it was just the water pump. All very easy to sort then you have a nice reliable little motor.

These cars are very easy to sort out, garages are very keen to just fob people off with "head gasket" at mention of a 1.8 k series.

Couple of hundred quid will probably see most of its little niggles sorted.
 
Unless you have plenty of money to throw at it forget about getting anywhere with the seller , as he is selling into the market that he knows wont have that ability to fund anything legal . Save your money and use it carefully to sort out your problems, and make the best of a bad job , as advised by previous posters. You have had a relatively cheap lesson in life! The time to have asked was before you did the deal , not now :)

thanks for this ...... trying to get up to speed on whats what - the recovery guy said the battery seemed fine as apparently the charge was how it should be? just when turning the ignition the battery light comes on and it doesnt turn on obviously ... haha.... i was advised about 100 quid for an alternator? about right?

drivers window has dropped - im assuming its more the mechanism but no idea where to begin taking the inside panels off to attempt that - so planning on getting all done at the garage ... the leak comes out near the bottom of the door

ill be sure to advise the above and see whats said regarding the heaad gasket - sounds lik i know what im talking about ahahahah

im hoping i can get it back on the road for next week at minimal expense ... thanks for al;l the advice :)
 
99% of the time it's just a cable which really is easy to do. There's loads of guides on how go do it on YouTube. Do it yourself, save £50 from paying someone to do it and feel smug knowing you've fixed it .

including fitting 100 - he said plus 75 labour? nightmare - will i catch a break?
 
ill also look into doing the window myself too :)

Have a look on ebay. Loads of good used ones from mgzt 's on there fir 20 quid delivered with a warranty. Get yourself a manual, a new alternator belt and jobs a good un.

You have checked that it's not just the belt might have snapped haven't you ....
