I'm gutted. I bought a Disco 2 from a trader 6 weeks ago. Last week I started hearing a loud clicking from the engine and I took it into a reputable Landy garage. They've told me that "someone" has recently worked on the engine to "fix it up" and my crankshaft is completely knackered. They say a new engine is required.

When I bought the car, the trader had me sign the usual disclaimer "I understand that this is a used car and accept that it may have faults" etc.

Do I have any comeback at all? I'm wondering if the Sale of Goods act section 14 applies here, as not fit for purpose?

Any advice much appreciated.

Get ya sen to the citizens advise they point you in the right direction..
Hope it works itself out for ya buddy, nothing worse then feeling ripped off....
 
No warranty. What if the Trader says that there were no faults when he sold the car? My mechanic is prepared to put in writing, his findings, which are that at some point the car was running with ZERO oil and that is a likely cause. Since I bought it, the oil level has been fine.

Grrr! Have just spoken to the trader. Apparently I signed for the purchase for "spares and repairs only" He says he can't do anything about it.

Where the feck does this leave me?

Hopefully you have a copy of the original document that states "I understand that this is a used car and accept that it may have faults" etc. and doesn't anywhere include the words "spares and repairs only"




Otherwise I hope I'm wrong in saying you're up a little brown river in a barbed wire canoe without an outboard motor! :(

Firstly "must go quick" and "no offers" would make me instantly suspicious.

Secondly this means very little, especially if the seller has documentation signed by you stating that the vehicle is sold for "spares and repairs" :eek:
 
think you might be on a bit of a sticky wicket with that, you have effectively acknowledged that the vehicle has faults and is not fit for use as a motor vehicle without being repaired.

as above, you need to speak to citizens advice really
 
Have been on to Trading Standards, who advise that including the term "spares or repair" could be viewed as a criminal act, as it was clearly advertised as "excellent" and assumes the car is drivable. They have asked for the Trader's details.

Thats as maybe, but a document including those words signed by you is evidence that those terms were accepted by you :eek:

Never mind trading standards you'll need the srvices of a damn good lawyer too I think :(
