The ATF sounds like it defo needs freshening at the least if not a full flush. IIRC you can only see one side of the diff gears inside the IRD. That would be my guess.

From what you've described I'd be leaning towards it being the Jatco box at fault here although I've no idea what failure can produce your problem... Have you dropped the gearbox oil? What colour is it and does it smell burnt? When it skips drive do you get any noises and if so can you isolate...
