Agreed. Looking at that I'd say the bracket has been bent so it's sitting up.

there should be some spacer rings (c rings).. they look like washers but with a side cut out so they slide into the gap where the bolt sits. That will adjust the side that has dropped if they are slid between the bracket and the bolt thread recess
