My Adrian Flux/ULR insurance claim woes!

Fair doos , same happened to me, bloke behind was looking the other way and whacked into me:)

I dunno where the 3rd party was looking but when I stopped he was a fair way back.
And he decided the application of brakes was clearly not needed.
Why would he when there's a lovely trucky to stop with!
It just sucks that people not at fault get hammered when I'm fairly sure he's got a spanking new car.
When did your own insurance start to work for the third party is what I'd like to know?

that's why he paid for insurance though. it's not his fault flux is being a nightmare.. keep remembering to direct your anger at them.

You should be in a position of equity ( no better or worse off than before it happened)

Citizens Advice will tell you the same as I have, if your being ####ed about-complaint in writing recorded delivey stating you want xyz and final response, make it clear that you will go to ombudsman.

Also it sounds like the vehicle isn't road worthy-where is the FREE hire car?

Did you suffer any whiplash or see a doctor?

Yes I have no hire car.
She's drive able but needs sorting soon because of the steering wobble

Has it been assessed as safe to drive? Are there any broken lights or reflectors -is there anything that the accident caused that would fail mot such as sharp edges??
If there is then the vehicle is deemed to have defects and demand a hire car until your vehicle is repaired.

Driving into back of vehicle is classed as absolute offence, if you stopped and the person behind didn't- the fault is 100 % theirs.

If you want to be difficult, demand genuine parts and reject insurance approved cheap ****e pattern parts.

I had AA check it over as safe to drive as in no splits in chassis or fuel tank. But they never drove it
Just looked externally.

The 3rd party are splitting hairs over labour costs not the parts (ie: flat refusing to pay the labour rate)
I'm not prepared to budge over the garage I will not be going to a bodyshop but my garage.
My garage of course have quoted genuine parts not cheap alternatives. And I fully believe they will use those parts not just charge for them
 
Okay final though of the day.
Call ombudsman ask for advice, (my stepdad and I are hanging an insurance company out to dry) keep it very brief and your get answers.

Have yu "Suggested " that you will be claiming for all costs including hire car - which, of course will get more expensive the longer he continues prevaricating,

One point that strikes me is the next problem will be insurance company claiming betterment.

Secondly I haven't seen pictures-is it bent cross member or chassis rippled?

I'm not playing devils advocate, but through no fault of your own the vehicle has been damaged and should be back to a pre accident state and no better or worse off (equity)

One of my customers who is an independant assessor for the the 3rd party insurers gave me a little insight into how they work.
Basically they want to not pay over a certain amount for any job within a set criteria ....side impact=set price
Rear impact=set price and so on. He seemed to think no matter how much I shouted and stamped my foot about going to my garage that I was tilting at windmills and would get nowhere.
Bleak!
Quality of work does not come into it
Just budget that they have to fit the claim into

The rear step bumper is bent, with split welds and has rippled and dented the rear crossmember.
She had an immaculate ass pre accident
Apart from the usual towbar dent in the tailgate ;)
 
I found accident exchange really good, I was rear ended (car was parked at the side of the road I was in bed) and after about 3 months of just dragging the whole thing out as expect they sent me a cheque and said I could arrange the repair myself.. Ended up working out quite well for me.

Perhaps you should have stated the vehicle wasn't drivable, because when they insurance company start having to pay £££ every day to loan you a hire car it speeds things up a bit! :p

I also wonder if that's another thing limiting their budget, I.E if the car is drivable damage should only be superficial and cost less than x
 
Hi,

The trouble we have is as a broker, we are working on behalf of insurers so there is only a certain amount we can do when it comes to Claims. Claims are dealt with by ULR.

I will again try to get this looked at in more depth, and again I do apologise on behalf.


I just wanted to post to make you all aware I have aknowledged this post and am trying to provide a resolution.
