So there trying to blag it and say there’s a fault when there isn’t actually one at all?
So can’t it be fixed and go off at all then mate?
If it's an early model pre-2003 ish, then the ABS light is designed to stay lit until the vehicle has exceeded 5 MPH. It's a feature of the ABS system design, so no it can't be turned off. It also won't fail an MOT, as there a vehicle specific manual that the MOT testers go by, which explains the ABS lights and test procedure for each and every vehicle on the road.
This ABS lights thing is explained quite clearly in the owners handbook.
If your buyer is a muppet and doesn't do his research into freelander ownership, then he really shouldn't be buying it, or the next thing is he'll be on hear asking why the IRD has just exploded, and how much it'll cost to repair.

From the owners manual:
"Illuminates for approximately 1
second as a bulb and system check
when the starter switch is turned to
position II, and briefly extinguishes before
coming on again. If the light does not
extinguish and then come on again, then a fault
has occurred with the ABS system and you
should consult your Land Rover dealer at the
earliest opportunity. The warning light will
remain on until the vehicle is driven above
approximately 5 mph (7 km/h).
If the light remains on or subsequently
illuminates while driving, a fault has been
detected by the self-monitoring system. This
means that full ABS control may not be
available and you should consult your dealer at
the earliest opportunity."
