Hi all, just lifted my boot carpet to check some wiring and descovered the entire passinger side of my boot has rotten through the gap is huge so it has been this way for some time.

I have had a load of problems with this car and have only had it since the begining of november so far the front diff has given up/ tracking is off and a load of pita jobs reverse lights that kind of thing.

A few days after i got it a pin hole devloped in the brake pipe leading to pressure loss and a replacement pipe and now this.

it is clearly going to fail its next mot on it and i wanted to put dickie seats in the back which i clearly cannot do with the boot in this condition.

my question is this where do i stand legally? if i make them aware of the situation are they abliged to repair it or am i entitled to my money back?

Its a 93 200tdi and the people i bought it off are the people who moted it with a fresh mot for when i bought it.

:( not really didding owning a landy at the moment

You get 90 days 'warranty' on rust on an MOT. You may be within the timescale. If the rust isn't anywhere near a structural point (suspension mount, seatbelt mount etc) there is no reason it will fail an mot.
 
was it from a dealer of a private person? what sort of money did you part with for it?

the boot floor should have failed the MOT if its holed (really common problem) as should the brake pipe if it holed due to corrosion it should have been picked up on MOT
 
here are some pics to put it in perspective.

I bought it from a 4x4 center not to far from me but the last registered keeper is not the 4x4 center its the previous owner before them who was one of their clients. it was moted the day before i bought it buy the same company. I paid 800 for it cash which was fairly pricey considering it was bog standard but i was in a rush and there was no others in my budget locally.

I called them and said that the brake pipe had gone and to be fair they came straight down and changed it.

but this amount of rust is no joke shurley this is an mot fail?

I will contact them on monday but i wanted to know where i stand first.

I have searched for the crock o ****e thred but cant find it?

With that amount of rot it clearly has a dodgy MOT. on those grounds alone I would suggest you have a very good legal standing!
 
and you said i had a expensive disoc. Still its not great pal to be honest. Theres along standing battle when it comes to boot floors. they aren't structural, so don't normaly fail, some tester do pull them however. So from the mot side of things maybe you don't have a case, however i could be wrong. As for the sales side of things, like others said take it back quoting the above and see what they say.
 
thanks for the link puppy, if its as alex said and its a grey area then i think its fair to say i know its had a very relaxed inspection. I don't know if i should call him explain im not happy and see what he offers or if i should take it to vosa and go down the offical route straight away before contacting him to show its a serious complaint and im not messing round.

despite all this i still really like disco's and definitly will have another one hopefull with a few less holes!
 
Say to them that they will need to fix it or you will have to ring the number on the back of the MOT Cert. VOSA could stop them doing MOT's.
 
Always give them a chance to put things right. The guy could be genuine, why ruin his business unnecessarily. Speak to him Monday, I wouldn't phone him I would turn up on the car lot and show him the car. Be polite and call him aside away from any members of the public. he will appreciate that if he's a genuine guy, and your more likely to get a decent response. Good luck and keep us informed.

That int the boot floor though that the wheel arch onto which the N/S rear seatbelt is bolted. and well within 30cm of the mounting a definate fail. and can't claim it was hidden by carpets etc as it's obviously showing daylight.
 
phone them up and tell them you think it has a dodgy MOT (relaxed as you called it) and tell them you are going to take iti too the vosa testing station you will be suprised how qiuck they react, i am under the impression car sales places cant do there own MOTs so you might find you have to ring the place that did the test as it will be them that will lose there licence

How many 17 year old cars suffer from rust? most I would say. As has been said give the seller the opportunity to put things right, if its just the boot area affected its not as dramatic as it might look. If you go down the route of Trading Standards, it could be a long drawn out affair. Regarding the mot, depends how close the corrosion is to seat belt anchor points. I know of a similar vehicle went for the mot, it failed on corrosion within the seatbelt anchor area. The owner removed the seats and the seatbelts in the rear, it then passed on retest. Your vehicle may well have gone through the mot without any rear seats, in which case it would quite legitimately pass the mot. In your case I would repar the boot floor myself and save a whole lot of hassle.
 
Go with the advice by puppysandwich, You can always start off nice , and become nasty , its very hard to do it the other way round . If they have any sense they will sort it for you, as it will lead them into a whole lot of pain (VOSA sale of goods act etc ) if they are dickheads as they are a commercial enterprise and should know that . JMHO
