What I should have spotted before buying :-(

well following on from my , 'ACE light is flashing red, and I have only just picked it up' thread.

it was looked at by a LR indy, they fiddled it, and it was ok, dealer brought it back to me.

1 week later it happens again, dealer says- you take it in I'll sort it.

So I take it down, indy takes another look, and I 'notice' this

OOOOOH ferkin really. that goes quite deep, indy said he has never seen corrosion like this on a TD5

MOT is 20 days old, apparently they didnt spot this minor fault in the rear chassis.

The dealer rolled straight away and said bring it back, I'll give you your money back.

Q is though, should I inform VOSA? this could seriously ruin someones day, ie the tester, I am torn between not wanting to ruin someones livelihood, and the thought that some other mug might buy it, not notice and get hammered

thoughts?
 
Just go get your money back. Let it be someone else's problem. If it hasn't put you off buying another one, make sure you check everything.
 
inform VOSA? YES, (after you have your cash back) this could seriously ruin someones day, (it has, yours) may be someone else might not be so lucky !!! ie the tester F**K THE TESTER someone should ruin his livelihood !!! before he ruins someones LIFE !!

if you put the TD5 in for a MOT at a trusted garage DO YOU THINK IT WOULD PASS ????
 
Obviously any hole in the floor in passenger compartment or load area is a fail. Door, bonnet and tailgate hinge and latch mounting points are also structural as would be an external spare wheel mount.
The MOT tester is right but experience sugests the VOSA tend to go for the strictest interpretation in roadside checks.

Corrosion

A vehicle can fail with respect to corrosion for:

excessive corrosion in a 'prescribed area' — within 30 cms of certain safety related components, e.g. brakes, steering, suspension, seat belt mountings etc.
excessive corrosion not in a 'prescribed area', but which is likely to adversely affect the vehicle's braking or steering. 'Excessive corrosion' can mean a hole or a significantly weakened structure.
