Rusty boot floor, the MOT and possible dodgy dealership

Hey everyone, I have a series of very important and related questions, but first a little background.
I paid for and collected my N reg Disco two weeks ago. Sorted my insurance, but the vehicle was taxed until the end of August and I was told the car had an MOT until November but the boss had sent off to get a duplicate because they had bought it from a trader and all of the papers hadn't come in.
I had a phone call from the dealer saying they couldn't get a duplicate, and if they could have the car back for a few days. Not really practical as they are 40 miles away and I use the car for commuting.
They sent me through the V5 so I checked (using direct.gov.uk) the validity of the MOT. It expired in June-shocked.:eek:


So, I've nipped it up to my very friendly MOT centre and they have failed it on rear/driver body mount/sill area and the boot floor, where the corner has rotted. So what I need to know is:
  • Where do I stand with them saying it was MOTd?
  • Who is liable for the welding I need to pass it?
  • If I am, how much will it cost?
I never had it in writing that it was MOTd until November so I don't know if I have a leg to stand on.The MOT centre don't do welding, so does anyone know someone good/cheap in Bedworth, Cov or Nuneaton?
 
If you bought it from a dealer it has to have an MOT. Unless it was sold for scrap. It isn't as described and it isn't fit for purpose, because it's not road legal and it needs welding.
 
I picked it up and the guy watched me transfer the kids' car seats from my old car...I can feel a red mist building. Couldn't get in touch with him because they had shut when I had finished at the MOT centre.
 
i'll ask my mate tomorrow if he has time to do the welding for you(very busy at the minute),he has his own workshop/bodyshop up at furnace end.i'll let you know
 
Thanks guys, I'll ring the snakey little **** in the morning and try to get it sorted. I'll let you know how it pans out.
 
Update: Rang the dealer this morning and without fight he took it back and is doing the work, he was full of regret. He did seem really shocked by the hole in the boot.
Hopefully will get it back Tuesday or Wednesday.:D
 
Make sure you check the work has been done to a good standard before you take possesion again. Don't just rely on a new mot cert.
