Do you need to have proper bench cushions in the back for people to sit there?

My series 3 88" came with cushions for your arse but they are not attached down in any way. There is no kind of back rest or anything. Think that's alright? Don't know if they're original as I haven't seen them anywhere else but they fit perfectly. Here is a picture, not the best but hopefully you'll see what I mean:

Thin line to tread here. My series 3 came with something similar and Mot man got sniffy about the rear seat belts. His advice was remove them before you bring it in. I took them out and threw them away, it looks like an unpleasant place to sit.
 
V5 doesn't have anything under number of seats, I think it didn't need to at the time it was registered?

How do I check the VIN? If I do the DVLA reg check the "vehicle type approval" is "not available"
 
My s2a has rear bench seats and no seat belts and has been mot tested by a ministry man.

My neighbour has a s1 with just cushions and that passes at the same place.
 
It's not the seatbelts I'm worried about, I know you don't need them. It was just the fact that I have no back rests and only the seat bases (which aren't attached down)
 
IIRC there needs to be seat backs to be classed as seats I vaguely remember someone getting round a loophole for class of MOT on a 101 by bolting some seat backs to the side of the 101 so it was not a goods vehicle
 
Ive been told by my insurance (when i put a centre seat in) that no sideways facing seats will be insured, so as has already been said, get that checked out
