lost service book

Hi everyone
Please can anyone help
Just sold Land Rover discovery yesterday. 2005. It was sold with many bills proof of repairs al Mot
and proof of services from my local garage bills that go back to 2007 he now has decided he wants service book
Big problem is unable to find service book
Phone DVLA to see if any chance of finding first owner??! to see if he or she could tell where he bought it from New Long shot ! No help
Land Rover couldn't help either. So the new owner want his money back!
Unless I find the old service book. Given me 7 days to find it
Any advice would much be appreciated

Bills and repairs. When he took the car home and started going through paperwork he said it wasn't there?!
and now is kicking off by law he has a right for refund.
 
Do a deal without it. If he really likes the car he will keep it. It will cost you money though. Cheaper than taking it back and reselling.
 
Do you know if he’s actually driving the disco?

Have you asked for a warranty sheet/build sheet from LR dealer it may show original dealer who sold it and they may have history, long shot maybe

Are you sure. Private sales don't have the same rights as from a dealer/car jockey.
 
They're going to try and keep the car and get cash back from you...refund and re-sell...did you note mileage when sold might be a bargaining position if it's significantly different...take it you sold on eBay?...
 
He said he wants to keep the car as long as I can find service history but sadly hit a brick wall with DVLA
and Land Rover.

Why would they have a service history...DVLA would only have change of owners and Land rover won't have a complete service history of a 14yr old car...
 
Simple One - Essentially, the car needs to be as described in the advert and what you told the buyer when you sold the car.
If a car isn't as described then the buyer is covered by the Sale of Goods Act 1979, which states that a car should be of a satisfactory quality, fit for purpose and as described in the advert.

So it depends on what you said in the advert and in person during the sale - was a Service Book ever mentioned or confirmed as present? If so, the Buyer has you.

I’d offer a modest part refund ‘without prejudice’ to reflect the marginal devaluation of the sale price due to a missing Service Book - it’s not really a big value on a 2005 Discovery if as you say the bills corroborate it’s history. The buyer is just bending you over because he can.

If the offer is not enough in the buyers eyes then cancel the transaction.
 
Who would worry about service history on a 14 year old car?

How much did the op sell it for? ie is a it a top end low mileage minter? or is a minger?

I would argue that it has a full service history if it came with 12 years of receipts for work carried out regardless of whether it has a piece of paper with a land rover logo and dubious garage stamps! Unless the service book was specifically mentioned in the advert it has 12 years of service history, end of argument.
