When I reverse then move forward i cant get out of reverse its also some times moves forward when the clutch is fully pressed down, Is this a clutch problem and why has it gone only doing 40K.

that was poor daft...

40k is acceptable for a clutch thats had a hard life, i.e. LOTS of heavy towing, holding the car on hills. But, that kinda use suggests that the clutch is worn, which wnt stop you getting gears.

When was the clutch fluid last replaced? I bet anything that if you replace and bleed the fluid, and maybe adjust the master cylinder, you have a problem solved.

do you also 'ride the clutch'? I.e. rest your foot on the pedal when the clutch aint in use? Cos this will knacker the release bearing in no time, which could also do what you are finding.

Thanks all for your help, its had an easy life but i did forget to mention its my wifes car, its had all services scheduled. If i hold the clutch with the brakes on its still stall the car.

...f i hold the clutch with the brakes on its still stall the car.

what you mean by that?

if its had an easy life then i rekon jus get the clutch bled, or do it yourself - requires minimal tools an skill, tis jus a bit fiddly!
