I went to Court yesterday over being sold a Discovery that didn't last very long, I lost the case; but the chap that won, won a very shallow victory.
He only won as the judge could not be sure that he was a car trader, I know that he is but proving it is not easy. His shallow victory now means that the people who did not know him before, know him now, i.e Trading Standards the Court itself and the taxman.
The experience has not put me off, and I'd urge anyone in a similar position to go for it, but before spending any money get as much proof as possible.

The uk court system is a joke. No suprise you lost. at the end of the day (if i understand correctly) some guy sold you a dodgy car. fact that he may or maynot have correctly registered as a car sales person or not shouldn't be bought into it.

Theres a village somewhere where a mid terrace turned into a greecy spoon - house either side massivly dropped in value + can smell the greece + have rat issues now.

They got the law involved, as no planning permission for change of use, etc. - but because the greecy spoon owners are now applying for planning after converting which takes longer and all is in progress they are exempt from all hygene standards, trading, etc. until the planning is complete - until then its just a residential property.

They clearly don't meet food hygene standards and are selling food to the public but food hygene won't get involved till planning is sorted.

Yet another great example of our pointless legal system.
 
The fact he is selling on E Bay, and claimed to have had the Discovery two months prior to selling, and in the two months he did not see fit to change the ownership of the Land Rover to his name. Interesting experience and not over by a long shot.
Don't know his E Bay I/D mores the pity.

If he lives nearby every car you see for sale at side of road near him have a look at the advert in the car window and take photos if his phone number is on it also dates.If you see him selling cars on ebay do a print out and build a file up.He will sell on the bay but also park a car up on a street and sell that way.Once you have a nice big file then contact HMRC and your solicitor as if he is dealing and the HMRC nail him you could revisit this case with new evidence.

Surly that would have been enough for the courts cos if he bought it as a private owner it is the sellers responsabilaty to inform dvla, unless he used the trade part of the log book in which case he must be a trader? Foooking legal system in this country always seems to come down on the side of the wrong do'er c$cks. :mad:

Trade Plates, wish I'd remembered that yesterday.
Yes I thought the fact he hadn't registered the vehicle might have gone against him, never mind one day.
Is it possible to find out through the DVLA if someone has Trade Plates?

you dont need trade plates to be a trader. i buy and sell 1 or 2 cars (all above bord) and i dont have any trade plates . when you buy a car private just check that the whole log book is there before they send it off. if the yellow part is missing its a fair chance they are a trader.
