    I have just been ripped off by an Ebay trader by the name of skitt55-2008.
    I bought a pair of seats to refurbish one front seat on my renovation project P38.
    His first attempt at shipping failed as the items were miss described and turned back either by customs or the shipper. When they eventually arrived, they were a totally different colour to the listing, so I refused to accept delivery and they were returned to him.
    Because I was unable to take photo's, Ebay will do nothing and the trader has refused to refund, so he has the seats and my cash.
    Not happy.

    The joys of Ebay.......when it works well....it works well......but you only have to have a dishonest few to spoil it for all!

    Did you pay via Paypal or credit card? Might be some protection there? I tend to pay via Paypal and my Paypal is paid by credit card so I figure I have a couple of barriers to fraud.

    Paypal, no hope there I fear. I am pursuing it via Trading Standards.

    Yep, open PayPal case, he won’t have proof of delivery as you didn’t sign and they will ask for copies of any emails if you have them but they are pretty good and sorting things.
    If it was Ebay you will probably be better opening a case with them first as PayPal will direct you go them but ring them or message them and ask

    Ebay refused to do anything as I did not take photo's. I will try Paypal, but not hopefull.
    I signed "Delivery Refused" on the Tablet of the delivery company.

    ok, i guess they are taking the delivery refused as delivered, anyway of getting proof of return from the courier ?
    Paypal I would think would be better although still heavily connected to ebay

    Just thinking , let's take this from the start. Bear with me.
    Even if the colour hadn't been wrong, as an online buyer you have very good protection*, especially in Europe.
    Did you open a returns case on EBay( not just an email to seller)? If not, then do so, EBay will give the seller x amount of days to reply. If they don't reply EBay will automatically refund you. If they do reply and contest the return, scan your proof of return and attach to the case. Ebay will back you up. You need no other reason than you changed your mind, so remind eBay photos not required
    IF for some reason eBay does not honour your consumer rights, then involve PayPal. If that fails, ask your bank to do a claw back.

    Well just checked my ebay purchase history (the sellers name rang a bell with me) and I bought just the rear half of p38 carpet from him last year and got to say found him to be very helpful as I only wanted rear half in grey.

    Ebay rejected the case out of hand as I did not take photo's. I'm aware of the Consumer Contracts legislation 2013 and am taking action via Trading Standards.
    Ebay are more interested in protecting an established seller than the buyer in my experience because the sellr is where their income comes from.
